School want us to agree to illegal exclusion

Ds currently excluded and due back tomorrow. Had 'phone call from school stating that HT has said that if he had been in school that day it would have been a permanent exclusion!. They are 'happy' to have him back but are worried that things are escalating and he may get permanently excluded. This would stop them sending him on a re-focus course at the local short stay school for 5 weeks which they want to do. He only attends half-days anyway but they asked if he could have work set and stay at home! I have already contacted the council stating that we are unhappy that he is not receiving a full time education already. Dh is in poor health and is not supposed to get stressed and I have told them that we are struggling to cope with ds at home part-time now let alone full-time! Have now requested an urgent review of the statement. They clearly don't want him there do they? Sad

did you contact education welfare officer? do not agree to keep your ds home, tell school you intend to send him back asap, if your ds does get a px the lea have to find him another school placement, if you keep him home then your ds will slip through the system....i want to say a few swear words about the school but i won't, sending you all hugs and support

Write an email to the HT, Governors, Exclusions Officer at your LA and someone senior in the SEN dept. I usually cc in the SEN manager Grin

State that you will not accept the illegal exclusion of your child and that, in fact, exclusion full stop is not a way of dealing with a child with X need (whatever SEN your child has). Quote the Dept of Education's Guidance on Exclusions for Schools.

Start cc-ing in some bigwigs and you will get the HT on his/her toes.

Contact IPSEA or look at their advice on Exclusion on their website. they are shit hot at this type of malarkey.

are you in Scotland? We are and DS has been illegally suspended 4 times now, and I've read of one or two parents in Scotland saying the same thing.

No,not in Scotland. I have refused their request. Ds has real trouble completing school work at home as he believes it should be done at school! Had a medical appointment earlier and the specialist could see that school was a major issue as when he asked ds what was causing his anxiety he said ' not being at school full time like the other children'. I have tried contacting the County Exclusion Manager but she is never there and not replying to my phone calls or e-mails. I asked the question as to why they offered a help line for parents when no-one was ever available when you needed help and was simply told ' I will pass on your comments' Angry. I will try contacting IPSEA. We have had experience of similar tactics at previous schools so am really disappointed that this one too has failed our son.
