Taking on an ABA tutor - employed or self employed

Hi,

Am about to take on a tutor to work with our son just for a few hours a week. The number of hours may vary each week for numerous reasons- mainly due to funding and the fact that this is a part time ABA Programme.

So, I was thinking of taking on the tutor on a self employed basis as a more flexible arrangement suits both her and us better. Just wondering if most other people's ABA tutors work as employed or self employed. If she is self employed do I still need to give her a contract or get her to sign something to say she is working on a self employed basis and as such assumes responsibility for her own tax. Do I need to include notice periods etc.

All our tutors have been self-employed, so do their own tax. We have had contracts with them (though not all of them). Notice period is usually a month.

We also say that if they cancel a session we won't pay them, but if we cancel a session without sufficient warning we will pay them. This would in theory include holidays we take, meaning that we would still pay them for sessions missed if we're away. In practice though, we have so far managed to book holidays with enough notice that the tutors can rearrange their schedules so they can cover the sessions we cancel so we don't pay them.

Also a week off at Christmas and Easter (no sessions, no payment).
