LA EP threatened Independent Nursery today

Told them that if they didn't answer all her questions and disclose information, that there was a tribunal panel sitting shortly that would order them to do so......Shock

Poor nursery then did give details but tbh, nursery don't know the story so what they gave them was some of my musings. Mostly incorrect. So the whole thing is a bloody muddle.

Can you not meet with the nursery and help them prepare an add-on suppliment (prob incorrect word for it) and ask the EP to take this on board too?

Our nursery staff were called for a 'chat' which turned out to be a 2 hour grilling by a panel of 3 LA staff (these were 2 girls who were about 20). LA they came up with a load of crap about how the nursery didn't believe in ABA and felt forced to do it by aggressive parents. Nursery eventually conceded they had said some stuff but mainly because their back was against the wall (lots of questioning about what they had done against target and why we were saying DS hadn't made progress and wasn't that their fault etc etc) and said that the way LA had worded it was completely twisted. So for eg nursery would say well we do SALT target in morning and ABA have shown how to do this way - and LA would say do you have to do it that way - so nursery would say yes (because thats the only way DS would sit and do it otherwise he would walk off as before ABA showed them he wouldn't do anything) and so LA write big document about how ABA is rigid and the reason their outreach approaches haven't worked is because parents have banned nursery from using them and insist only ABA is used...you get the picture

In the end nursery did come to tribunal and say yes ABA works better - had a big wobble before we got to that point but came through (just) on the day

I'm just so cross that the nursery who have been absolutely brilliant were made to feel caught in the middle of something I never intended them to be involved in.

I sent an email to the EP stating that I was alarmed at her behaviour and am now refusing her observation (was due tomorrow) of ds as intimidation and upsetting of staff who have been accomodating and instrumental in ds' progress is not in ds' best interests and the LA best find another EP, preferably the one he last saw albeit 3 years ago.

Grrrrrrrrrrr.

DS' nursery don't know anything about ABA. All they know is that there are tutors that go in, make a HUGE difference to ds and to the other children, their staff copy it and ask questions and hey presto, all kids are doing better.

ABA never got mentioned, although neither has it ever been denied.

Get the nursery manager to put something in writing about how her staff were made to feel intimidated and asked questions beyond their scope of knowledge (I doubt she's happy so she should do this if asked nicely tbh!).

Then gather togther your ABA documentation and check that the lot has been submitted to Tribunal (the measurement of progress will make your point!).

The LEA can only call a max of 5 witnessness to Tribunal, and some young girl bursting into tears on the day will not help their case.
