Have a look at www.bhas.org.uk. It has a good step by step guide to what to do next. Just be careful as there are some time limits and you need to stay within them if you eventually want to appeal.

On what basis have you been refused on????
You can call them and ask them like i did yesterday, they were very helpful and offered advice on what to do next if i wanted it looked at again.

Ring your local DWP branch and ask for a written Statement of Reasons. That's basically their explanation of why they haven't awarded DLA and you can use that as your basis for asking for a reconsideration. I took my Reasons apart line by line and showed how they'd got it wrong. You can also include additional evidence as well.

You won't go to appeal unless you ask for reconsideration and you're refused again, but you can request copies of all reports submitted by professionals from the DWP and they must let you have them. I think (IIRC) you only have six weeks to lodge your intent to ask for reconsideration so you should do this straight away, then inform them that your additional info will be with them by the six week date.

CAB are very helpful with matters like this. Try and get an appointment with their benefits advisor if you can, but you'll need to be quick off the mark because it can be hard to get in to see anyone. Maybe the quiet festive period might go in your favour.

I wonder how it being Xmas affects the time you have allowed? I don't think its very long so better check asap. I think you should ask them to "look again", nothing to lose!

agree with davros, ask them to "look again" you can send any extra stuff in if you need to, i think they just pass it to someone else and they take a look and often come up with a different result, it did for us, good luck. what particular additional needs does your child have?
if it's autism then i may be able to help you out with a report.

I meant that the CAB might not be busy over the Christmas period, not that you'll get a different period of reconsideration from the DWP. At our local branch you'd be lucky to get an appointment in two weeks, so you'd need to ring them sharpish. I'm pretty sure it's six weeks for reconsideration though.

ask for reconsideration. i am still tackling dd2 forms, and got a reminder notice yesterday. hers isnt due to end till may.

My ds is 9 1/2 but has been assessed as a 5/6yr old he's dyspraxic, has got a anxity disorder, no short term memory or verbal reasoning and ocd. The case worker says he shows signs of being autistic he likes routines and at this time of year he gets very worked up he dosen't like change. I sent all the reports we've got of him i think it might be because of the school report i haven't seen it but he is very well behaved their and the only extra help he needs there is to learn.(We are currently trying or a statement.)

I asked the dla to lokk at my form again and to send me any reports that they'd recieved from others and today in the post i got the school report. The school have put that ds is average academicly! even though he has to have extra help out of the classroom and in the classroom everyday and there are reports from the ed pysch and others stating how far behind he is. I don't know what to do anymore it's not so much not getting dla but more the fact the school are saying he's average and not writing in the little box below saying what extra help he has to have at school. Why do that?

Can you talk to the SENCO and explain how important it is that they write down all the extra help he needs compared to the other children?

I did just can't understand why he wrote "average" then didn't fill in the box underneath saying he goes out with ta and also sits with one in the class to help him remeber what he's suppose to be doing. I am so angry and upset that the school are making out there's nothing wrong with him again.
