well done starchart, what sort of school is it and why did they appeal?

Well it's all a bit crazy but they appealed because then have 3 children with additional needs and 'support' going into that mainstream classroom and they thought that there would be too many adults which would effect the education of the other children.

However, ds final statement has failed to specify TA support or SLT for that matter (which is why we are going to tribunal) so they didn't have a case

Every cloud has a silver lining! If you are going to tribunal, will they still implement the statement as it stands in the meantime? Will your DS still get to start at this school in Sept? When is tribunal?

Well the tribunal won't be until Dec/Jan. And the statement has to be the crap that it is now.

However, we have the legal right to hold ds back until Jan, as is the right of all Reception age children and if the support isn't in place satisfactorily then we'll just wait.

I guess your plan means they have to keep the place but doesn't this mean your child won't get to know the other children and will this disadvantage them? I suppose though if there isn't specific provision for your child, the risks of what could go wrong would outweigh that?

I bloomingwell hate the compromises we have to make that impact on our kids because of delays in the system, it sucks.

I see. I didn't know if you wanted him to start anyway. I suppose without the right sort of support it might have set an unwanted precedent.

tbh I'm not sure what we are going to do. He has ASD. Without appropriate support he won't even be aware of the other children, let alone make friends with them so its a bit immaterial.

If his only chance of making friends is in Jan after the tribunal then he may as well wait until then and we can have some fun and term time holidays in the meantime.

Lots of children don't start til Jan. He's not going to make friends without appropriate support, so I wouldn't lose sleep over that. It'll give you a chance to have some transition visits with his actual class before Jan.

Also if he goes in befoer Jan, they'll just fabricate evidence that he is managing without specified support.

That's what I meant by unwanted precedent, really!

I agree it will be good to have some transition meetings and fun and holidays in the meantime sounds good to me. They've named the school and you can work with the school in the meantime and build up that relationship too.

Hope the LA see sense sooner and you don't have to go to tribunal.

Hmm, not really. The school won't want our proposed provision, but we're only going for it because we have to go to tribunal anyway, we may as well lay it all out!
