Seems unbelievable they may get rid of the statutory duties to provide short breaks - hasn't that one just been achieved?

This Government really stinks.

The other thing is for people to sign up to the EDCM updates. They're doing an outstanding job atm, imo.

ive done it and signed up for updates.Have not had anything back from mp yet.Interesting isnt it when when we have contacted mp in the past before his party got into government he came back really quickly.

I was told yesterday that they won't be having my child assessed for a statement as no one wants to commit funds as they don't think there are going to be funds to commit any more.

Did they tell you that in writing, babyheave? Or was it on the phone? I'm not a statement-wallah, but it sounds fairly illegal to me. Usually when they make illegal decisions they don't put it in writing and if you ask for a written response they change their story.

Yep, babyheave I would DEFINITELY insist on getting a response in writing. If they will not put it in writing, then appeal. You may actually have to request assessment again, but in writing, so that they are pushed to respond in writing. But somehow I don't think they'll put it in writing....

Or in my ds' case they just lie in their written response, and get caught in it, but only if I keep fighting them. This change in statutory responsibilties would just give LA the wriggle room they need to do nothing, provide nothing and support no-one.

My MP responds quickly to a personal letter, but takes much longer over this type of standard response.

It was in a meeting at the school when I asked whether they would push for a statement as they were all agreeing that he had additional needs. They said they would be doing an IEP and said I should wait until formal dx (he's being assessed for ASD) before going for a statement.

I said that surely if he has needs now we don't need to wait for a dx, which is when the EP said about the changes to the green paper where the LEA wouldn't be doing assessments any more, so they would be reluctant to assess.

Next route is me talking directly to the SENCO and asking that they ask for an assessment anyway and sending one off myself if they don't.

Babyheave, even if the school apply it's true they can't appeal but you can appeal, whether you or school apply. Ask that EP to put comment in writing!

I had a letter from Sarah Tether Minster for Children and Families supporting me in my fight with la, and citing the new proposed legislation as being helpful. This has given me the opportunity to answer her with my concerns and explain exactly why my ds would be worse off with the proposed changes and not better.....so I will be doing that as soon as possible.
