DH was thrown out of a class last week for being ten minutes late when ds1 became distressed on his way to SNU base transition session and delayed him.

He arrnaged a meeting and quoted DLA at him but uni says DDA does not aply to him and he would be locked out of further classes for same reason; this means he ahs asked me to throw in the work experience I have just got in palce as he is now refusing to do drop off JIC. I am pissed off and not a second rate fall guy for when the world doesn;t fit university's stupid unbeding rules!

Anyway- are theyr eally exempt from DDA? they say only employers need adhere.

?employment
?education
?access to goods, services and facilities including larger private clubs and land based transport services
?buying and renting land or property
?functions of public bodies, for example the issuing of licences

That's what I thought, but his tutor and head of dept sat him down and told him they were exempt and had no intrest in helping.

Student welfare have asked to be kept informed as theya re angry about teh DDA issue, any ideas of where we could print info off for them anyone?

University of Glamorgan AT Dept; told DH depression shouldn;t be a ccause for an extension back along when he was ill, now this. Caring bunch.

You are also protected outside work from direct discrimination, which could include:
?
discouraging you from using a service because you care for someone who is disabled
?
making it impossible for you to use a facility because you look after someone who is disabled
?
providing you with a worse service than someone else who isn?t caring for a disabled person.

Equality Act from here hth.

Hmm don't know where those numbers came from!

Must be the moon Nija Wink

Thank you- all info is appreciated. Dh says they actively laughed at him when he raised the DDA (he sent the link about the EU ruling beforehand) which tbh makes me very angry indeed.

there's this leaflet as well.

It's disgraceful, I can't see anything that would exempt them, under the old DDA I'm not so sure but the new Equality Act looks like they have to comply. Maybe they'd prefer to show him the legislation that exempts them? Make them prove it.

Even if the old DDA didn't cover him the new Equalities Act 2010 does. They have to comply, threaten them with contacting your mp, or actually contact you mp, that will get them being more helpful.

The Equalities Act covers both the "disabled" person and their carers in providing facillities for them to access all services, including education. I will try and hunt down some links for you.

Thank you any links welcomed and useful.

www.equalities.gov.uk/pdf/401727_GEO_EqualityLaw_Rights_acc.pdf

www.equalities.gov.uk/pdf/401727_GEO_EqualityLaw_PublicSector_acc.pdf This one indicates that they are a service provider, and therefore covered by the Act. age 7 begins the description of indriect discrimination, which applies to a rule in place for everyone which particularly makes life difficult for an individual covered by the Act, which as a carer your dh is. All the evidence you need.

SparkleRainbow · 21/03/2011 17:15

Should be page 7, sorry, typing fast as surrounded by chaos...well you know! Blush

SparkleRainbow · 21/03/2011 17:17

Hope you feel able to use it Scram. I am fairly up to date with the new Act. i have had to read mos of it, and am currently threatening my ds' LA with it.
