What do you do when statement provision is not being provided????

DD is not receiving her SLT at school this term due to the previous SLT leaving and currently no replacement being recruited as of yet.

I have complained to LA and contacted IPSEA who advised me to tell LA that they are not acting within Education Act etc....which I have done.

All LA keep saying is that they are in the process of recruting etc...
I have suggested that I will find a SLT and charge them for costs incurred, however, they seem to be totally ignoring this suggestion.

SLT is stated in part 3 of DD's statement. I thought a statement was legally binding. I know it is a resource issue but it still impacts on my daughter and I am not happy. Is there anywhere I can go from here?

Yes Local Government Ombudsman. Has the LA dealt with it through formal complaint procedure? Even if you have not gone through complaint LGO may look at it as your child is missing out on provision.

Thank you Agnesdi - I did not even know about the Ombudsman or that there was a formal complaint procedure process. I am looking at the website now. Thanks again feeling more positive Smile.

Hi I am new here, I too have the same problem in that the SLT looking after my son left and was never replaced due to cutbacks etc. My son isn't statemented so apart from alot of phone calls complaining to my LA,I had no choice but to hire a private SLT at my cost and boy I was surprised at the cost. My son has been seeing an SLT since 3 1/2 years old and recently has been diagnosed with APD. I have been told by the SEN teacher at his primary school my son would not be considered for a statement. What is the criteria for a statement I am struggling getting help from anyone on this matter, other than I would be wasting my time.

"Would not be considered", utter tosh!!!.
Do not take any notice of the nay sayers; these people have no say on the decision making. Make the application for a statement personally, use IPSEA's website www.ipsea.org.uk. LEA makes the decision as to whether to statement or not (usually not in the first instance) and if not, you can and should appeal their crass decision.

Only criteria for a statement is need. If your son needs SALT at school the surest way to enable that is to have a Statement in place. Its legally binding too unlike anything else offered to yourselves.

You may also want to apply for DLA as well.

Nickminilink - It is my understanding that if a child "cannot access the national curriculum" then they should be entitled to extra help. If you son is having problems due to his APD then he should have help at school. Does he get any support from the TA's at school? As Attila has suggested you can always apply for a statement yourself.

I had a similar lack of provision thing with my statemented daughter. She was meant to have 5x hours of occupational therapy and nothing was forthcoming- we were on a long waiting list and they'd let us know when we reached the top.

I found out (on here) that others in the area were being provided with OT through a private agency. I pointed that out and bingo- private OT sent into school to cover the waiting list...

Thanks for sharing that Negligent - you had a good result. I have let my LA know that I will be complaining to the Local Government Ombudsman. I didn't even know the LGO existed until Agnesdipesto posted on this thread. Mumsnet is great for this kind of info Grin
