Dd2 had a review in October and the LA said that they would be rewriting her statement and issuing a new one based on all the changes which have taken place. It is now end of Jan and we have still not seen any new proposed statement. Is this normal? How long should it take?

Sencop states:
The role of the LEA after receiving the review report
9:34 The LEA concludes the review process by considering the report of the review meeting
and the recommendations prepared by the head teacher. The LEA must then review the
statement, in the light of the report and recommendations and any other information they consider relevant. The LEA must decide whether to accept the head teacher?s
recommendations. In particular the LEA must decide whether to amend or cease to
maintain the statement. Within one week of making a decision, the LEA must send a copy
of its decision on these matters to the head teacher, the child?s parents and anyone else
they think appropriate.
9:35 Where the decision is to amend the statement, the LEA should start the process ofamendment without delay.

I would be chasing them up if I were you asking when they are likely to issue the new sm.

the most relevant bits of sencop seem to be ch 9, para 32 to 35
headteacher must prepeare a report and submit it to lea within 10 school days
..review shd be writen as quickly as possible .. so that lea can make decisions without delay
where the decison is to amend the statement, the lea should start the process of amendment without delay" www.teachernet.gov.uk/_doc/3724/SENCodeOfPractice.pdf

3 months doesn't sound like without delay to me.

I think you should definitely have had it by now - I think pinkorkid is right with the 10 days.

Thanks for all your replies. I have been very patient I think! I don't know about you guys, but every so often I just run out of steam for a while and get fed up of chasing them. Am ready again to start chasing them. I am not sure about your question Leonie.I would have thought eight weeks from receiving it??

I'm pretty sure they have to stick to the original date for when final statment is due - although this timetable may be allowed to slip if you request more than one meeting with the lea to discuss how crap differences over statement.
