nephew with disbracsia

hello, im new to the site but i wondered if there is someone who could help me or give me some advise.
my nephew has been in full time school since september,he was also in the schools nursery last year for the whole year. just this week my sister was told that he could no longer be at school full time as they did not have the funding to support him one-one any more but he was welcome to be at school for two and a half hours in the afternoon, he has disbrcsia and does need some supervision the school have told her that he is not eligible to be in full time school until april even though he is 5 in december.the school also say that his statement will not be sorted until april so they have no provision for him until his statement is in place.
as you can imagine she is very upset about this and very confused as to what to do now so any information that anyone could help with we would really apriciate it thank you in advance. Confused

I saw your post earlier and was hoping someone with more knowledge would come along and answer it, but this will bump it if nothing else. IMO they have no right to do this. They need to apply for some emergency funding of some kind. It is not as if they had no prior warning of your dn's needs as he was in the nursery for the whole year previously. I am also assuming that the other children are all the same age as him and are entitled to be in school. I think your sister will have to get tough with them. I would start by getting some advice on the legal position from one of the SEN charities such as IPSEA or SOSSEN, they will be able to tell you what your rights are in this situation. Then, write to the chief executive of the LEA, copying the letter to the head os SEN at the LEA and the headteacher of the school. Whilst the term they are five is the legal limit for starting school. many children start reception before this. Your nephew has as much right as everyone else to a school place.

I presume you mean dyspraxia?

I'm fairly sure it's not legal for school to refuse to have him full time.

Ring your local parent partnership. They will help you get your nephew into school fulltime.

This all sounds totally unacceptable.

The school legally HAS to find the funding for the child from somewhere (anywhere). I ad this problem a few years ago when my DD was a mid-year SEN transfer, and the new school tried to take away all the help she had been getting. Contact the inclusion officer at your Local LEA. If he is 5yo before Christmas, then he LEGALLY HAS to be in full time school by January, as it is the term after they turn 5yo that is the legal age for school. If the LEA have alocated this as hs school, then the school are on very shaky ground here.

  1. Contact the inclusions officer at your local LEA. They will rip the headteacher a new one try to get this sorted out.
