Hi I hope someone can offer advise. My DS 3 next month is on Action plus and recently diagnosed with ASD. He attends a specialist asd nursery for 2 sessions a week, I was intending to apply for a statement myself and spoke to them about this but they have offered to apply since they have the experience of this and said that my applying would confuse matters. Is this good news and should i hold off? Any advise much appreciated. They are lovely people and the nursery is wonderful.

It's good news that the nursery intend to aply. You just have to make sure that they actually do so. I'd keep a close eye on things and expect to get a letter from the LA very soon saying they's received the nursery's request.

If not, you'll need to apply yourself.

I am no expert on this, but think the advantage of applying yourself is that you can appeal if they refuse and you then maintain control over the process. The nursery would be asked for their input in any case. I'm sure someone else will be along with more expertise though.

There's no advantage in the parent / school applying - in the evnt of a refusal the parent can always appeal.

If school applies and is refused the school has no right of appeal but the parent does have the right to appeal.

Obviously if the parent applies directly but is refused they can appeal.
