Writing to LA advise please

I have just composed a letter in response to the LA's refusal to issue a statement and fobbed me off with a note in lieu.

What i would like to achieve is for LA to back down now and issue a draft, so i can save time appealing the NIL and just appeal the draft statement.

I have lots of evidence and i know that the LA would back down before appeal for NIL got to Tribunal. I have lots of new evidence for example ds scoring on 0.4 percentile for a SALT assessment.

ASD Advisory teacher observing he couldnt work well in a small group, difficulties with communication, rigid thinking, separating fantasy from reality. Couldnt change a book without adult help, couldnt refuse a piece of fruit without coming close to tears etc, etc.

Do i hit them with all this now in the hope they will issue a crap draft statement and i can then hold back and go to tribunal with a draft?

Your son has documented needs. The law is on you side. The LEA are playing for time as time without giving your son the support he needs saves them money. The more time you give the LEA the happier they will be.

Claw You can go to your MP perhaps about the NIL. The LGO possibly as an emergency SA can sometimes override the whole nonsense. The regression stuff might make it viable.

Have you asked for help from the Social Services team who give support to children with disabilities?

Stark, ds has a CAMHS appointment tomorrow and my report from them supporting my application for a statement should be ready, im hoping this evidence will hold a lot of weight. So im holding off until tomorrow and will hand deliver letter.

Lucinda, the LA have recommended social worker contact school and for all the wrong reasons i suspect, i dont think they are thinking about supporting me, more like trying to blame me.

I told school i would be happy for them to pass my number onto the social worker and she could call me. School told me no the social worker wants school to discuss ds with them, not contact me! I have told them they do not have my permission to discuss ds without me being present.

The NIL seems to be suggesting that help is needed at home, not school, simply because CAMHS are involved therefore making it the parents fault by default.

Yay have a brill CAMHS report where they basically spell it out that ds experiences confusion because of his social/peer interactions and this is making him overwhelmly anxious and engage in self injuries behaviour and they are worried that if he doesnt receive the appropriate help in school this will escalate.

They conclude that support that ds requires would be difficult to sustain without the resources provided by a statement.

Should that do the trick?

Oh Claw, what a journey! You HAVE to be SO proud of yourself for having kept going. You're still a way from the top of that mountain but you ARE beating it.

Remember to rest occasionally and adjust to the new climate.

They are even blaming 'events during the day' being responsible for his poor sleeping and eating too! stick that in your pipe and smoke it LA!!

Hi Claw I echo what Star says. You've been inspirational in your epic battle with the LA. Keep on fighting and you'll get there in the end!
Great report from Camhs - was that from a paed or a counsellor? DS's counsellor says that his anxiety is due to us and the school being anxious about him and asked why we needed a dx - doh!

Fighting, report is from clinical psychologist and child psychotherapist.

CAMHS were very much like that with me, when ds first started going because of what old school had told them, prior dx too. But ds has been having weekly one to one for almost a year now and they get ds to re-enact through games and play when he feels threatened, anxious etc and guess where that is!

Will hand deliver my LA letter today, so hopefully 7 days from now!
