Refused Statement Query

I don't want to make this a long post, so will try not to go into too much detail!
My son who has Dyspraxia, Hypermobility and sensory issues has just been refused a Statement.

On the 'Note in Lieu Of A Statement' the Lea writes that the Statement has been refused because he has made progress in his attainment and that he is well supported at school (which he is). My contention I suppose is that whilst he has made some progress in his attainment, it has been small, very hard won and does not match his ability. But more importantly that the reasons for us seeking a Statement are not predominantly concerned with his academic progress, but more to do with assisting him in social situations with his peers (in the playground where he is teased and ostracised) and interventions to prevent his sensory seeking behaviours marginalising him in the classroom. As an example he is currently not included in any group work because his fiddling,leaning on/ touching people is distracting for the rest of the class - he is made to sit around a corner so that he cannot be seen.

More importantly he is sad, confused and over the past year his self esteem has plummetted.

The school have been very good, but they are at the limit of what they are able to provide from their current resources and agree that he needs additional support.

I know the 'mechanics' of appealing against the decision, but I suppose I don't know how to word my concerns most effectively. I sent off so much stuff with the initial request for a Statutory Assesment, I don't really know what else I can say Sad

Any help would be greatly appreciated!

Hi,

Look at IPSEA's "refusal to assess" pack. Another independent organisation called SOS:SEN are also good with regards to such issues. Also ACE may be helpful here too.

Tell the LEA in question to stick their note in lieu where the sun does not shine!. It is not legally binding and is thus not worth the paper its written on.
