Decision about whether to issue a statement due by tomorrow

What are the chances that I will actually find out tomorrow......

I'm steeling myself for a fight having read some of your stories on here about trying to get more provision put in and going to tribunals (starlight - yours particularly)

I apologise now for the fact that I will be asking for your help in the coming weeks years with suggested wording.

That is of course assuming we don't get turned down Hmm

Good luck, but it is unlikely that you will find out tomorrow. The SEN Code of Practice gives tomorrow as a deadline for decision, but the deadline for letting you know is 2 weeks later, the date on which they must supply you with the proposed statement of special educational needs.

Damn Lougle - really? We are going on holiday in 2 weeks. I know we've only got 15 days to comment on rewrite the statement and most of those we will be on holiday. I guess I'd better let them know...

No, don't panic. You can respond to the statement simply by saying "Need to make changes/meet/consult whatever, but am away for x days, so will need extra time. We will let you know by dd/mm/2010 what we think"

You're allowed to go on holiday. If you don't agree with what the Statement is proposing then write to them within 15 days of receiving it and ask them for a meeting.

You should state you will be unavailable between x and x dates. They should respond by offering you 3 choices of date for a meeting.

MN is such a mine of info - I didn't know the LA had 2 weeks to let me know!

I have been waiting impatiently for my decision which was due yesterday!

I called my case officer at the end of the 10-week period to ask if they'd decided whether to issue a statement or a note in lieu. They were happy to tell me over the phone, so it's worth calling just to ask if they've decided to issue a statement.

It's quite rare to issue a note in lieu instead (which is what happens if they decide not to issue a statement) but I didn't want to be left wondering. They won't send anything until two weeks later.

I have the case-worker's email address so may try and see if I can get a response from her that way. I know she is going on holiday imminently.

starlight I have been told informally by parent partnership that the hard part is getting our LEA to agree to assess. Only 2 people have apparently been turned down at this stage and one of those won on appeal.

I would be very surprised if we didn't get a statement as every single professional involved wrote that he needed 1-1.

Just phoned LEA, draft statement was posted out on Monday Shock and should arrive today. I'm at work so won't get it until I get home. Now the fun starts....

indigo have been meaning to post on your thread about statements - but I was told to get try and get as much evidence as possible before putting in the statement request as if you get through the panel stage then you are very likely to get a statement.

My ds gets hardly any provision at the moment so hoping statement will be slightly more!

Statement arrived today. Needless to say it needs a total re-write as they've just pasted in the recommended therapy provision from the NHS SALT and OT and ignored the recommendations from the private SALT and OT. I am going to start a new thread once I've digested it as I have lots of questions that I'm sure some of you will be able to help with Wink
