I would say that they can't do that. Perhaps a call to your local early years and childcare service would clarify matters.

I can understand their difficulty if they are short of staff and feel that it compromises the children's care but IMHO it's a problem they need to show that they are taking reasonable steps to accommodate all the children. If that means getting funding to cover more staff the EYCS should be able to advise them.

well thats what confused me. Early years team have said they will fund a 1-1 worker for her but then manager said 1-1 worker is already providing 1-1 for other children in mornings. I think they have a staff memember they just give the 1-1 work too rather than hire ones when needed. Would also question if the children get 1-1 or rather like 3-1 Hmm

Sounds a bit odd to me, where I am if we were offered extra funding for a 1-1 we would get someone in to do it or one of the experienced staff would do the 1-1 and get someone in to cover them.
I wonder if they are feeling swamped by the number of children needing extra support, is it a commitee run pre-school if it is sometimes the pay is really poor and it is difficult to attract experienced staff.

Lisasd when ds was at nursery in Essex they did same there just used a member of staff who had no training or experiance gave extra hrs rather than employ some

now I would not stand for it

It's illegal to refuse proper assistance to a child with a disability, for example, (Unless there is a world-class reason for it involving dire health and safety matters or near-bankruptcy if they do etc). Just not planning enough staff isn't a reason.

Worth finding out what their reasoning is, certainly.

well she tried the "its not in Jasmines best intrest for her to be here with the 1-1 strengthed over so many sn children" Hmm
we have a TAC next week will let it rip there Grin

Surely the 1-1 funding that each sn child has been identified as being entitled to, is 1-1 funding for them individually, not the group! Hmm I appreciate that the nursery may have to meet some of the funding for each extra support needed, and the la meets the rest but even so.....I am sure that is not legal.
