Star - I have some idea of what you're going through, although it wasn't nearly as tortuously long. Any of us would have broken down long ago.

If you can make the time for yourself for some pampering, that sounds good. You know you've got loads of support on here, we're all rallying for you.

I just got into a bit of a rut where I thought Bastards are making me wait so long, and then thinking, the tribunal was on 16th July, and it shouldn't have gone to a)gone to tribunal, b)gone to a second panel hearing as the first should have been managed properly.

And then I look to the future and see that the LA have 6 weeks to implement it (no longer in time for ds starting Nursery) and that knowing the LA, they will still drag their heels. Perhaps it will be in place begninning Jan, and then in Feb there will be the Annual Review (6 monthly at ds' age) where they have already told me verbally that anything we win at tribunal will be removed.

Sure I'll fight that too blah blah blah

But what's the fucking point! I just want to take ds and go and live in the desert or something, or failing that take the whole family and jump off a cliff.

If you win the tribunal, though, they will be forced to issue an Ammended Statement, won't they? If that is the case, surely the review will be triggered 6 months after the Ammended Statement date?

I htink Lougle is right re: statement date.

we finalised ours in Jan, to move to tribunal.

obviously we never got there, as LA caved in, but since they were amending statement (name of school only - no school had been named before, just "nearest appropriate school"), statement date was end of April.

so, since statement will be amended, they have to re-type (took my LA 2 weeks to change that one sentence on ours...), and new date will be the date they send amended one to you.

Yes. That's right. New final statement End Oct, review End April.

BUT, ds will be going into reception Sept 11, meaning that the 'tranisition statement' has to be issued by 15th Feb 11. I'm certain LA will use that as AR and removal of provision.

It isn't reasonable/fair or probably legal, but since when has that had any relevance?

Add to that the fact I doubt they will meet the deadline of end Oct to get provision in place anyway as it is difficult for a parent to challenge (but not impossible, although all you win is the LA getting told off, your child is meanwhile failed).

It's okay, I've bounced back already. What choice do I have.

I REALLY REALLY appreciate the support I've had here though. I'm in no doubt at all that I would have given up a long time ago if I hadn't had that, and although it might look like I could have been a lot happier in ignorant bliss, I know me and know I'd probably be somewhere a lot less pleasant than I am now.

Hang in there.
The worst bit is over it really is and you are so fortunate in that you have got the wheels in motion at such a yonug age.

In my experience, in the end lEAs and PCTs stop messing with people when they see how far they are prepared to go. It just makes thier lives full of misery and hassle too-remember that. They are human, not robots and it is shite for them too to be going through this on top of all the hassle and workload that is part and parcel of being a public sector worker.

Not excusing, just explaining.

We learn and grow from these experiences. It sets us on a different path. You know my story. I'm not the same person I was a few years ago but in a good way.

Moondog The LA have just initiated an ABA elimination campaign, and hired a solicitor (we were the first that they set him on) to get rid. I suspect they are fresh for the fight.

However, you ARE right that I've come far and what is behind me pushes me forward. They will never be able to match the man hours I have put in, nor will they ever be able to.

I do have to thank you (for lots of things actually) for kicking me up the bum in the early days when I was faffing about on here and dabbling with ideas on how to progress in apologetic belief that ds was very young and I was jumping the gun a bit.

Again, whilst all this shit is going on (at extreme emotional and financial cost to my family I have to concede) DS is thriving, as is my DD.

Actually Moondog, I have something funny to email you re the LA ABA elimination campaign. Can't really go into details here but if anyone else has any interest in Herts and their ABA angle I'm happy to share.
