EHCPs and industrial action

DC's school is heading into their 4th day of strike action this week. DC has an EHCP.

I'm fully supportive of the action, so not actually going to do anything about this, but was interested in what the legal position on EHCPs and industrial action is- because it's obviously not being provided during a strike. I couldn't find any info online and wondered if anyone here knew.

They've not been asked to attend as a 'vulnerable child'- because they're not otherwise vulnerable I suspect.

I don’t know what the legal position is, but is it different than that of any child, who’s teacher withdraws their labour during a strike.

I would speak to the LA and school about DC attending as a vulnerable child.

The school’s best endeavours duty and the LA’s absolute duty will still apply.

Yes I think maybe there's almost 2 separate things:

-The school is on strike so 'normal' education is not available

-DCs with EHCPs are also likewise not getting their interventions as set out in the EHCP and that's a legally mandated X number of sessions of y per year/week/whatever (and there is an equalities impact because it will take them longer to catch up, can't keep up via independent learning etc).

It's all interesting. Think I will raise with the head actually.
