Hi I'm after some advice about what to do/say on mandatory reconsideration. My son is 2 years 7 months hes non verbal and non mobile. He relays on me for everything, he can't dress/feed/drink/change himself. He wake numerous times at night and can take up to an hour to settle him each time. He can't sit unaided, he has a standing frame, walking frame, specialist bath seat & push chair. We've had to get a ramp fitted due to him getting to big to lift his specials pushchair in and out. I have also fell down the stairs twice carrying him as been refused a lift and extension by social care so have to carry him up and down the stairs. He has global development delays, hypotonia and epilepsy. He seizures daily with myoclonic astatic which causes him to lose all body muscle and drops with no warning having 20/30 a day, hes on 4 different medications. He also has tonic clonic causing violently shaking and unconscious(we have rescue meds) he has them randomly last one 30th October with 5 back to back. We was given middle care for 8 months so didn't argue it with him being young we have just got back his renewal and keeping him on middle for 4 year. When I have spoken to his care profession they have all said he should be getting high. He was put into induced coma in April for 6 days and he actually went backwards with his development since 1st getting dla. Any help will be appreciated as i have never been through this before. Thanks

You need to explain why DS meets the criteria for HRC and reference your evidence to support your points. For HRC, you need to demonstrate DS needs help or supervision day and night in excess of what is typically expected for DC the same age. Night is classed as the “period of inactivity” that begins when “the household… closes down for the night”. This is usually considered to be between 11pm and 7am, but if your household closes down before that at e.g. 10pm it can be possible to argue night starts then. For the night part, you either need to show DS requires prolonged (typically considered 20mins+) or repeated (typically means 2+) support with bodily functions during the night or someone needs to be awake for a prolonged period or at frequent intervals (typically considered more than twice) to watch over him to prevent harm, but remember that it is in comparison to typical peers the same age.
