Moving borough

Dear Mums,

I am stuck in a dreadful situation. My kid is autistic with moderate learning problem. Kiddo got an EHCP but attending mainstream stream as when he started nursery , there were no place to offer to him . After pushing council for 2 whole year , we decided to go to Tribunal to secure a place in specialist setting .Now ,LA found a place for him and will be started from next academic year.
Now the problem is we are in the middle of buying a new house in different borough mainly because of my kid as he needs more space for his sensory room and equipments (and there is really nice specialist school close to our new house which is primary as well as secondary school which will be beneficial for him in long run if he secure a place in that school).We are happy to do long school run because we don’t want to miss this opportunity for him as he already suffered so much in mainstream school . We are planning to move in March next year

Can anyone suggest how to tackle this situation? Any advise would be greatly appreciated Shall we let him start new offered specialist school from next academic year and then requested new council to transfer him to the specialist school near new house as I heard that if a child is in specialist setting then transfer to another specialist setting is easier rather that from mainstream school to specialist school ?
Alternatively, We have to postponed our dream of buying new house which will be very difficult 😞

When you move LA with a finalised EHCP, the new LA becomes responsible for the EHCP, including the provision in F, and where it is still feasible for the child to attend the named school, the placement named, on transfer. That is on the day of the move if you give the new LA 15 working days’ notice or 15 working days’ from when the LA was informed of the move if you don’t.

Withins 6 weeks of the transfer, the LA must inform you when they will review the EHCP. They must review the EHCP within 12 months of the previous review or 3 months of transfer, whichever is later. As part of this review, you can pursue a change of placement. However, ultimately, you may have to appeal, whether the review happens before or after DS starts the SS linked up from the 26/27 academic year.

There is also a chance the new LA will potentially reassess or even propose to cease to maintain. You will get the right of appeal, but it is still something you need to be aware of.
