Help please I need advice for my son who has Sen x

Hi everyone bare with me as I rubbish with the terminology when it comes to SEN, but just for context my son is 4 years old, he is autisc non verbal and adhd, he is very very full on has lots of energy, not much fear of danger and doesn’t often listen to instructions (sometimes does at home for example putting his rubbish in the bin or picking stuff up) but not really with people that he’s not familiar with. We moved to a new area on October the 6th and he started reception on October the 8th. After having met with the teachers and the senco I don’t think they expected him to have such high needs on his first day of reception they told me to pick him up after having been there for an hour, explaining to me that he was very unsettled and threw sand and toys and was running around the room. After this they called me in for a meeting and they decided that they wanted to take him out of the classroom and let him come in everyday for an hour to sit and play with a teacher in a quiet room, then because one of those days he was big unsettled they said that they wanted him to come in for 45 mins everyday in the quiet room, all whilst gathering evidence to apply for a ehcp which has already been rejected once when he was in nursery, my problems are with this
-how will they gather sufficient evidence for just 45 mins of play everyday for an ehcp
-are they allowed to just exclude him from the classroom having only tried him in there once
-am I being unreasonable for wanting them to try harder with him and actually let him do more hours rather than just 45 mins

I understand that he can be quite full on but I feel as though they are just palming us off as they just don’t know what they are doing

You can request an EHCNA yourself now. You don’t need to wait. On their website, IPSEA has a model letter you can use. If the LA refuses, appeal.

Follow up all verbal conversations with emails so you have a paper trail as evidence.

The school calling you to collect like that is an unlawful, informal exclusion. You don’t have to allow it.

If you want DS to attend full-time (or part-time but more than for 45mins), he can. You simply inform the school DS will be attending and you won’t be collecting early unless they formally suspend. Don’t worry if they do formally suspend. A formal suspension rather than an unlawful informal exclusion it will a) provide you with evidence of unmet needs, b) force the school to follow due process, c) limit the number of days the school can suspend for, d) allow you to challenge any suspension, and e) once DS is compulsory school age ensure he receives alternative provision once he reaches the threshold for that.

When is DS 5?

What support has the school tried? Have they asked for advice from any outside agencies? Have they applied for high needs top up funding?

Thank you so much that’s amazing advice I’m definitely going to take action on that! I think it’s so unfair tbh I feel as though they are just trying to get away with doing as little as possible and because iv just allowed them to they are just thinking that I won’t say anything! He is 5 in April, the school have only just today let me know that they have a visit from outside agency to give them a plan on what they should do with him next but I don’t know when that will be yet x

Request a meeting with the SENCO. Follow it up with an email.
