What should I expect from school?

My 9yo has ADHD, awaiting assessment for ASD (nearly 2 years wait so far) and has an EHCP. He has had a number of assessments which detail his difficulties/needs. The school has copies of these reports.

We've had an EHCP for 3 years now. It's always a bit of a bumpy start to the year as the new teacher gets to know him, but this year has been pretty bad so far.

He's been getting into trouble all the time, for things that should be managed as part of his support.
Eg - he struggles to get started with work and needs to have things explained to him. He got into trouble for not getting something done in class
He panics when in a conflict situation (kids pushing him around, or accusing him of things) and is unable to communicate his side of the story easily, so if there's an incident he can't defend himself, so has been blamed for things that aren't always his fault. Hes getting so upset with the injustice of it all.

He's also reported being upset to the point of crying several times a day at school and tells us that he hates it, but this seems to have gone unnoticed by staff.

In previous years the teachers were aware of his difficulties and put things in place to support him - all this seems to have disappeared.

What can I reasonably expect school to do about this? It seems like that teacher this year isn't interested in helping him in the slightest and is expecting him to behave/respond like an NT child, when he just can't.

Speak to the SENCO. The school needs to provide more support. The teacher needs reminding they need to make reasonable adjustments.

Are the things that were provided last year but aren’t being provided now detailed, specified and quantified in section F of the EHCP?

What therapies are in the EHCP?

What preparation and support around transitions does DS receive?

When is the AR due?

Thanks for replying. The AR is next month. I'm trying to set up a meeting with the SENCO & teacher before this, but struggling.

Most of the things he needs are in section F, but I'm starting to think that they're not as explicit as they should be, so that's another thing to tackle.

My gut feeling is that teacher has decided that he's just naughty, and not making any reasonable adjustments. I'm not sure how we deal with that.

If the provision is detailed, specified and quantified in F, remind the school the EHCP is a legal document. Alongside this, contact the LA because it is them with ultimate responsibility for ensuring provision is provided. If that doesn’t work, post back on here for advice on next steps to enforce the provision.

If the provision isn’t in F or is vague and woolly, you can use the AR, and subsequent right of appeal if necessary, to try to tighten up the wording.

The teacher needs reminding not providing reasonable adjustments is discrimination. Not making reasonable adjustments sets DS up to fail.
