ADHD and extra time

I've been looking at what adjustments my son, who has ADHD, can expect when taking exams. The main options appear to be rest breaks and the possibility of extra time.

He's clever but a very slow worker due to getting distracted or bogged down in the question.

Looking at the 25% extra time adjustment am I right in thinking they only get this if they are performing below average in tests? He's not performing as well as he could if he didn't have ADHD but because he's clever he performs at or above average. Does this rule him out of getting extra time?

No, DC don’t have to be performing below average for exam time. JCQ’s guidance explains the rules.

You need evidence of disability (but the evidence doesn’t need to say extra time is needed), the disability needs to have a substantial and long term adverse effect on speed of working, detail about how difficulties affect DC is needed from the centre, rest breaks need to have been tried, it need to be the candidate’s normal way of working.

I was looking at this section of the JCQ (image) which seed to say they need an EHCP or Form 8. He doesn't have a EHCP and Form 8 requires below average test scores.
I admit it's a long document which I've not read in full so may be have missed some other relevant sections.

You are looking at extra time under the learning difficulties criteria. If you read JCQ’s guidance again, a Form 8 must not be used where the disability is ADHD. A Form 9 must be used and standardised scores are not required.
