JADR hearing section I

Hello

I have an appeal hearing set for the 5th of July but last week I received a JADR hearing for the 25th of this month

background is my child is 10 supposed to be in year 5, was in a hub within a mainstream school and we applied for an ASD specialist provision. This was declined and a behavioural school was named. The primary stated they could not meet need and I had to send my child to the named school (against my choice) or keep my child home. I declined and stated I felt the named provision was not suitable and wouldn’t benefit them. I have now had said child home a year. Their behaviour was escalating and becoming more and more distressed in the setting which is how this come about (due to lots of factors) they declined my child stating their needs where SEMH and mentioned referrals to Cahms (they don’t exist) they have a ASD diagnosis and areas of need on EHCP are 1. ASD 2. CL 3. SEMH

now my child has not been seen by any professionals in this time. I have asked multiple times for the LA to apply for extra funding during this time for tutoring/outside agencies to support learning and non of it has appeared. I have been effectively home educating during this time. Old School has done a handful of welfare checks in this time and dropped off a few worksheets.

any advice about JADR hearings would be amazing thank you

Most people find JADR process positive. It is about trying to settle the case without the need for a full hearing. Try not to worry about it.

What is your evidence like? Have you had any independent assessments? How are B&F? Because the placement in I is the result of B&F.

Have you complained about alternative provision?

the evidence they have based their reasons on was a behaviour school that came in to assess. He did not take my child on his case load, saw her for less than an hour. It’s a very vague report literally 3 paragraphs and he didn’t offer any advice for the setting. The only evidences I have is the EP report and a letter from the EP stating my child needs an ASD setting to meet her ASD needs which would reduce meltdowns as needs would be met and wasn’t being met in previous school.

I have asked for new reports to be done and for her to been seen by professionals but it’s all gone ignored.

the consult also stated they couldn’t meet need due to my child’s mental health and that they had been referred to CAHMS so I called them and questioned this as there is no MH concerns and there was no records so they wrote a letter saying they have never had a referral for my Child.

Honestly I’m so over it all. I’d of cancelled the appeal if she didn’t want to go back because it’s been failing after failing.

If you have solid evidence an ASD setting is required (is this in the EHCP?) and the difficulties were a result of unmet needs, your case is strong.

If you have to appeal in the future and need more evidence, you could consider independent assessments. If you can't afford them and aren't eligible for legal aid, contact Parents in Need because they can sometimes help.
