Experiences of SENDIST hearings for refusals to issue?

I have a hearing next week and I’m very nervous. Can anyone share their experiences of what happened in this type of appeal and what your outcome was?

I am unrepresented. The LEA have legal representation and witnesses.

Try not to panic. The majority of appeals are upheld.

If at any point you need 5 mins you can ask.

Check the bundle is complete. It would surprise you how often it isn’t or isn’t in the right order. Make sure you know your way around the bundle - annotate/bookmark/sticky tabs/your own index/colour code, whatever works for you. Some people find the electronic bundle easier to work with, others the paper version. It can help to note down key points you want to mention and questions you want to ask. Sometimes there will be opening statements (although not always) and it can help to have a few bullet points in case there is, and a bit about DC. Don’t get bogged down in previous dealings with the LA even if it is frustrating. Don’t interrupt even if the LA does.

That’s very helpful information. I have
both a paper and an electronic copy of the bundle which I plan to go through in the next few days. I did not think to annotate or page mark so I will do that. I just hope I don’t fall apart at the hearing; it’s so emotive.

Good news you have both, that’s how it should be. Some people find one or the other easier to work with so think about what you find easier. If you do feel yourself starting to fall apart ask for 5 minutes.

@OvertakenByLego I’m really struggling with the stress and the nerves with the hearing looming.

I considered contacting the LEAs team and asking if there is a chance of a last ditch discussion to see if they will concede? Or is this madness to contemplate?

As difficult as it is try to panic. You can do this. Keep reminding yourself the majority of appeals are upheld. You can still liaise with the LA and there is still a chance they will concede.
