If Occupational Therapy is listed as provision, can this be provided at SEN support in a MS school?

I’ve a few threads active whilst I’m trying to decide if it’s worth appealing DDs EHCP refusal.

DD needs OT. The OT report for the EHCNA was vague and pointless. My basic research shows that if something “educates or trains a child” then it should be listed as provision rather than health in an EHCP. The OT is training my DD how to regulate herself.

If this is listed as provision, can OT be provided by the school to a child who is on the SEN register or would this warrant an EHCP?

Unless OT is in an EHCP it can’t be guaranteed and isn’t enforceable.

It is unlikely schools would fund ongoing direct OT for pupils on SEN Support. The provision may or may not be available via the NHS, but even if it is the therapy is unlikely to be for the same duration and frequency as provision in an EHCP.

@ThomasWasTortured helpful advice thank you. My mum has offered to fund an OT report for us. The NHS OT seems to assess and then discharge so DD will be taught some regulation techniques and then discharged.

If an OT recommends ongoing therapies, then I could appeal with the argument that DD will not receive this at school without an EHCP?

Yes, requiring OT can be part of you evidence for an EHCP being necessary. I replied on your other thread about not waiting to appeal though.
