How long does it take for an ECNA?

Just found out that our appeal against the LA's decision not to conduct an ECNA has been successful. I know the LA has 2 weeks to confirm they will start the assessment and that it could take up to 16 weeks. I want to know if it usually takes this long or if there is a chance it will be quicker. Also, how long after doing the assessment do they issue the plan and can we name the school? I ask because DS is in year 10 and we are running out of time. The timing also means changing school is going to be difficult if not impossible.

The timescales within Reg 44 SEN Regs apply. If the LA is not going to issue an EHCP they must inform you within 10 weeks of the date of the Order. If they are going to issue they must finalise within 14 weeks. It is unlikely to be quicker than this.

If the LA is going to issue you will be sent a draft and can state your preferred placement then.

EHCPs can last until 25, or 26 in some cases, so you aren’t necessarily running out of time.

Thank you floatingbean. So it the assessment and the drafting/issuance of the plan one stage rather than 2? Re timing, I meant more getting it sorted before his GCSES (very late now).

With an EHCP GCSEs don’t have to be taken at the traditional time or they can be re-sat.

The timescales are for the whole process, from the order to either informing you they aren’t issuing or finalising. Within the timescales anyone asked for advice or information as part of the needs assessment must respond within 6 weeks.

You also need to be aware there is a possibility you will need to appeal a refusal to issue &/or the content/placement.

Hi all, does anyone know what the position is with sixth form applications IF DS does get an EHCP? Can he name a school for A-levels or does it depend on his grades/reference?

Unless the school is wholly independent the LA must name your preference unless the LA can prove:
-The setting is unsuitable for the age, ability, aptitude or special educational needs (“SEN”) of the child or young person; or
-The attendance of the child or young person would be incompatible with the provision of efficient education for others; or
-The attendance of the child or young person would be incompatible with the efficient use of resources.
