Independent review panel

My DS5 has been permanently excluded from school. Governors upheld the decision. We are now going to go to the Independent Review Panel. Has anyone been to one before to give me some tips/ advice? The school massively let my son down by not supporting his Sen needs.

This is what the school should do

Where a school has concerns about behaviour, or risk of exclusion, of a child in one of these vulnerable groups, it should, in partnership with others (including the Local Authority as necessary), consider what additional support or alternative placement may be required. This should involve assessing the suitability of support for a pupil’s SEN. Where a pupil has an EHCP, schools should consider requesting an early annual review or interim/emergency review.

Is this exclusion for a one off very violent incident or is it an accumulation of exclusions and incidents?

Sometimes an exclusion can show that a specialist setting is definitely required. My own dd with asd attended a mainstream primary. She had lots of 1.1 support and eventually the school said they couldn't meet her needs. She was never excluded though as they were able to manage her with 1.1. I did however start looking for a new specialist school when they said they could not manage her. Have the school indicated already that they cannot meet his needs?

You can ask for there a SEN expert to be present. They are supposed to be impartial and advise on if/how a pupil’s SEN is relevant to the situation and whether the correct duties were adhered to.

The independent review panel can’t make the governing body reinstate DS, but they can decide their decision was flawed and they should reconsider.

If you haven’t already, reading the statutory exclusion guidance will help.

Separately to the independent review panel have you requested an EHCNA or if there is already an EHCP in place asked for an early review? If DS is CSA are other arrangements being made by the LA so DS receives a suitable, full time education?

We have applied for EHCP, waiting on the outcome.

The LA has organised 1:1 tutor for 90 mins a day, 4 days a week. However he's very clever, it's the social side he needs. I feel so sorry for him 🥺

He started in September, by November they said find another school. So they then did little to help, not contacting specialist teachers etc as they thought we would just move him. Which is impossible when all schools are so heavily over subscribed anyway in this area.
We don't want him back at the school, but they can't treat Sen children this way.

The fact that he has SEN is not in itself enough to make the exclusion unreasonable. The panel will look at what happened as well. What are his SEN needs? When were they identified?

You need to email the LA’s Director of Children’s Services reminding them 6 hours 1:1 per week is not a full time education and threatening judicial review. If that fails contact SOSSEN for help with a pre-action letter.

What week of the EHCP process are you on?
