Permanent exclusion with ehcp

Heya.

I have a child diagnosed with trauma adhd, aniexty ocd and serve attachment

He has a ehcp with high funding. We have been though a lot as family in the last 6 myhs 3 close grievements
2 last year in the space of 2 weeks and the other in January,

At school he safe people he goes to since September has left 4 of them!

We've had to move out of our home after 11 years. Into another area as the landlord was selling!

He's has a new head of year and because of DV he doesn't get along with men which is in his ehcp!

He doesn't like change, and they keep excluding him

The head of year is finding faults to exclude him. Doesn't listen to him when he's upset, and he's in a negative cycle atm and there is no praise just punishments!

Now he's looking at permanent exclusion, he's been a lot better since and he's noticing if he has been rude so today a child wrote on a desk he took it into his own hands and told him off as it's damage ( he likes things to be fair) and went straight back and siad I shouldn't of said anything I'm so sorry and apologised to the teacher and the child, and that is along way for him!

Yet my other son same age (twins) a child out a pen in the way and he sat on it and I had to rush him to the hospital as it went through his private bits, and the boy didn't get excluded as there was no evidence even tho I heard the boy say to my son I'll pay you not to tell the school!

Anyway my point is with a EHCP and all the mental health issues and the struggles going on at home, can they permanently exclude a child!

I know there's safety of other but most of the school is like it!

A pupil with an EHCP can be permanently excluded. It can be disability discrimination if the exclusion is due to the pupil’s disability, but the school may well argue the had a legitimate reason such as health and safety.

You need to request an early review of the EHCP ASAP. Is the EHCP being followed?

Focus on your child, not the other pupils.

I've found a few things that aren't being followed especially by teachers and have brought this up, I have also asked for an review asap! He's good as gold at home but at school you can tell he's anxious he doesn't eat all day until he comes home!

My main focus is my child, but it's hard when he says oh there not getting excluded and they done this and that!

He was fine until everything happened! I feel they have gone through a lot at a child and need some support!

I've never had a review for ehcp as I got this when he was in year 6 and since then in 6 mths a lot more has happened!

I'm dealing with all this as a single mum no family support no help from anyone. It's really hard to know what to do

If the provision specified and quantified in F isn’t being provided you can enforce the provision, via judicial review if necessary. When did ask the LA for an early review? Does the EHCP include SALT, OT, MH therapies?

You can’t control what happens to other pupils and you won’t be privy to all the information, so there’s no point focusing on other pupils not getting excluded at all.

Have you had social care assessments? A carer’s assessment for you and an assessment via the disabled children’s team for DS.

And also EOTAS who partner with them. Both are really useful for info and guidance on SEN children and how to advocate and push to get what they need. They can also offer help (small fee or easily cancelled subscription ) I found them super useful for my DC when I had no clue what to do with the school. They are run by mums who've gone/ going through it.
