Ehcp assessment

Has anyone been successful in gaining an EHCP for their child that isn't academically too far behind,also undiagnosed but on the asd pathway for assessment?
I'm experienced with the process but being told the usual about not being delayed enough ect ect
Child has sensory needs,emotional regulation issues,social issues and anxiety.

Not my DC (one of mine already had their ASD diagnosis, the other has other complex needs), but I have helped other parents whose DC have a similar profile to your DS secure an EHCP.

Not being delayed enough isn’t a lawful reason to refuse an EHCNA. The only lawful criteria are a) has or may have SEN, and b) may require special educational provision to be made via an EHCP.

Thanks for that .I'm definitely going to go for it then at least an educational psychologist has to be involved as I think they are trying to downplay a lot of needs.

Appeal if the LA refuse, the majority of appeals are upheld.

An educational psychologist doesn't have to be involved with an EHCNA. They definitely won't be if they refuse to assess. They may not be if they do assess, although they should be.

Not saying you shouldn't put in an application though.

Not being delayed enough is no legal reason.

I thought they did?

Ds is academically able and has an EHCP. He did have an autism diagnosis when we applied but that shouldn't make a difference, as it's about needs.

Initially our LA refused to assess, we got them to change their minds. Then they refused specialist school. Again they changed their minds, although we had started the appeals process.
Ds is a bright young man with 10 GCSEs but attends an expensive independent specialist placement, as his needs are significant enough to require this. All of it funded through his EHCP.
It's not an easy journey, but if a child or young person needs the extra provision that an EHCP can provide. Then their academic ability should not prevent that from happening.

An educational psychologist doesn't have to be involved with an EHCNA

As part of EHCNAs the LA must seek advice from an EP as per Reg 6(1) SEND Regs 2014. The only exception is if there is an existing report that the parents, LA and report writer agree is sufficient and still up to date.

Thanks everyone,like I say I'm experienced with the EHCP process I was just making sure I was correct in the whole "the child doesn't have to be academically behind bit " because we all know schools try it on 🤷‍♀️.
And an Educational psychologist is always used around this area during the process .unfortunately it's the only time any child gets to see one around here 😡

My county doesn't have any educational psychologists. The report for a recent EHCP was completed by an Ed psych in Ireland who conducted a video interview with a 5 year old!
It basically just reproduced everything parents and school said!
