Incorrectly marked as present in school

Hello!

School has been refusing to have my daughter in school, she is being sent home after part days, but school has marked her as present for both morning and afternoon sessions in the register.

This smells odd to me. She has an EHCP, and they seem to be excluding her by the back door.

Can anyone advise on this - is it fishy to do this, and if so how can we get this rectified?

You need to email the HT to raise the matter and insist it is corrected, but also to put an end to the illegal exclusions.

If DD is being sent home without being formally excluded they are illegally excluding DD. Refuse to pick her up unless she is formally excluded. Put everything in writing.

As DD has an EHCP you need to also email the LA and inform them, they are the ones ultimately responsible for ensuring the provision in the EHCP is provided. Do you need an early review?

Technically if they've taken the afternoon register before she's sent home she would be marked present, but if they're refusing to have her they should be formally excluding. Mind you, this backfired with my DD as they said each exclusion has to be longer than the last so she ended up out for 2.5 days not just the afternoon.

She is at home every afternoon. It’s a disgrace, it is because they are unable to meet her needs rather than because of any bad behaviour. I feel so sad for her.

And to clarify, it’s not that they get to a certain point in the day and then say ‘we’re sending her home’. It’s that they’re saying ‘we are not having her in the afternoons’.

OP don’t allow the school to continue illegally excluding DD, stop collecting her unless she is formally excluded. Email the LA’s Director of Children’s Services too. And ask for an early review.

The school are telling you lies.

I think it's a school policy rather than anything else. They do actually seem to have got a lot better at identifying her triggers lately so not going to argue it for now.

The school aren’t allowed to have such a blanket policy.

Get on to her caseworker! She's entitled to a full time education
