In-Year transfer to new state primary

My DS (6) has had a torrid few years at school. He has no diagnosis but has been served four fixed-term exclusions from his state primary school for emotional dysregulation. He is on the school SEN register and has an IEP. School and the Govs are not particularly supportive or empathetic, nor are they doing the things they say they will in order to support my child and prevent further exclusions. I have just applied for an in-year transfer to another state primary in the Borough because I think the situation at our current school is, frankly, toxic. Can the state school to which I’ve applied refuse a place for him based on his previous exclusions?

An application can be refused if they have good reason to believe DS may display challenging behaviour and the school has a high proportion of pupils with challenging behaviour or previous permanent exclusions compared to other local schools and admitting another pupil with challenging behaviour would prejudice the provision of efficient education or the efficient use of resources.

Have you applied for an EHCNA?

Based on my (superficially) similar experience, although I never changed DS schools, there would have been no point and the only thing that helped was the long hard EHCP process.

I wouldn't count on a supportive school being better, DD's are ( even if it doesn't always feel like it) in that they actually do what they say, and in fact she's pretty much stolen the class TA but have reached the he limit to what they can do until she gets an EHCP. However she has also had two suspensions due to violent meltdowns.
