Help I need EHCP advice, getting my head round it is driving me nuts.

My dd has several SENs( ASC, dyspraxia and possibly ADHD). She also has an eating disorder and is in and out of hospital. Only in school 40% this year. First year of Alevels.Due to being physically and mentally unwell she can’t focus in lessons, do homework etc. She is on the Dynamic Risk Register.

Hef school have said they can just get somebody to draw up a self study plan with her. That is it. It’s a grammar. She won’t be able to take exams just being left to self study. Doesn’t really help when in hospital or re all the work missed.

Keyworker lady said she wouldn’t get an EHCP as they are giving provision..

I don’t understand it all. If the provision doesn’t do much surely she’d be eligible for an EHCP

You can apply yourself. Schools and LAs often tell parents DC won’t get or aren’t eligible for an EHCP but the parents/young person go on to successfully apply themselves.

The only threshold for an EHCNA is a) has or may have SEN, and b) may need SEN provision to be made via an EHCP. A pupil unable to attend full time due to their health meets this threshold.

The thing is she has been put on the pilot Keyworker scheme and the lady running that said that on speaking to the school they said they could meet her needs so we’d be turned down and she didn’t want to waste our time. They aren’t though.Confused

As I said, schools and LAs often tell parents DC won’t get an EHCP but the parents/young person go on to successfully apply themselves. If you are refused, appeal, the majority of appeals are upheld.

I agree with dory don't let them put you off.

Ds attended a grammar for 5 years and they were unbelievably unsupportive. It's left him with some significant trauma surrounding school. It was a completely toxic environment. And their SEN provisions and pastoral care were non existent. At least having an EHCP you can force the provision.
Although the environment might just not be right for her. Grammar schools can be really difficult places for young people with additional needs.

There are a couple of things - if she is physically and mentally unwell, what is she currently able to cope with.

If she is unwell and not able to access, not sure post 16, what responsibility there is to LA with regards tutors/ hospital school.

Maybe need to look if setting is suitable, would college and focus on 1 subject whilst unwell and as hopefully recovery starts add in others.

EHCP can have funding for education other than school e.g tutor. Definitely worth applying.

The LA’s statutory duty under s.19 The Education Act 1996 to provide education to those unable to attend school only applies to CSA pupils. There is no such duty for post 16 pupils. The only way to force provision is via an EHCP.

Will she be eligible for one if just sitting there in body but not in mind due to the Anorexic thoughts, depression, malnutrition, ASC and dyspraxia inability to focus….She is doing no work as can’t access it( first year of Alevels).

School seem to have written her off for this year. Extra time in exams a la her crappy IEP and somebody telling her what to self study which is all she gets is all pointless.

Ds is 17 with an EHCP. He is autistic, has severe sensory processing difficulties, anxiety, depression and an eating disorder. So yes it's possible to get one for a young person in sixth form struggling with those kinds of issues

He's in year 13 and dropped out of A levels back in November. Due to similar difficulties as your Dd and his school not supporting him adequately. He's a bright young man but currently can't even concentrate to do any school work. A levels could well be an option again at some point but are not possible at all at the moment.

This was the third school that have not supported Ds well enough, so have been there and got the T shirt with unsupportive schools. The grammar school especially would not help at all or support our application for an EHCP. His present school although more sympathetic, didn't offer him the kind of support he needed to access the mainstream environment.

Your best bet is to make a parental application for an EHCP. It may well be that your Dd is not well enough to continue year 12 and an EHCP could open up alternative provisions or different options for support.
