Can a school share a child's EHCP hours with a none statements child?

Pretty much what the heading says really, I work with a child 1:1 25hours on child's EHCP, the school have said child now shares his hours with a child who has no statement possibly won't for another year. But this is all the time all day, the child with the EHCPs mother still thinks her child is completely 1:1 as his care plan states.

It depends on the EHCP. If section F is specific and quantified the 1:1 must be provided and the parents can force the LA to provide it. However, sadly, many are not. They include phrases such as "access to" "or equivalent" "would benefit from" and can not be enforced. Many parents don't realise their EHCP isn't enforceable until they need to enforce it.

Thank you for replying, I have read the EHCP as far as I can remember it just states 1:1 25 hours. I also know for sure that if the child left school my contract would end as I am only employed by his funded money if this helps.

It depends on the wording in section F. My DDs school attempted this and nearly broke the poor TA

Well as soon as I mentioned this doesn't work, and there is no time for EHCP child they have change it back to just 1:1 so I am now wondering if it mentions it has got to be solely 1:1 the child had personnel care needs etc

If it is actually specified in the EHCP that the child requires 1:1 support for 25 hours each week then no, they shouldn't be using those hours for any other child.
