Appeal Process (not agreeing with named provider on final EHCP) anyone with experience/help?

Following our LA suddenly deciding this week that on DS2's final amended EHCP that they are going to name a different provider (one we have never even considered as they don't meet his needs and basically sit them in a classroom all day, every day) rather than our preferred one who offers full living skills experiences and supported work experience.

I was finally given the reason for the being down to money - the LA's preferred provider (who has never met our son and only gone from his proposed EHCP) bid £9,000 whereas the provider we wanted, he has spent a term doing transition events etc was £30,000.

Obviously we are going to appeal - what are your experiences of appeal? Any hints/tips etc? I am starting the process of gathering as much information as I can from the college he has just left in regards to why our preference is the most suitable and trying to gain info from the provider the LA want to send him, but given the time of year realistically we know that we will struggle to get anything until September but any help will be very much appreciated

I recommend SOS SEN's booklet on appeals - information on this page.

If you can afford it I would get a SEN experienced solicitor and private SLT/OT reports to back you up. IME if this other school is saying they can meet need then the LA aren't obligated to go with your preference. You need to argue how the other school cant meet need.

thank you for your messages - the named provider has admitted via email that their bid was a provisional and they do not have a clear set programme for DS therefore given his needs this cost will go up. Their academic programme is also not suitable as DS is operating at a higher Entry level for maths, english than they provide, he has also completed some of the other courses that they offer.

We received his final EHCP through today, so we can start the ball rolling

The legal case below might give you a few ideas:

Best of luck/x
