Notes in lieu

My 6 year old has Note in Lieu which includes 10 hours 1-1 support a week. He has a diagnosis of ADHD but, being adopted, also suffered a lot of pre-birth and post-natal trauma which has had an impact.

He is now medicated but the 'down' can be very tricky to manage.

His teacher last year was fantastic. This one is saying all the right things but it's quite clear that she doesn't want him in the class. And nor does the new head want him in the school. He's been threatened with formal exclusion as, frankly, they just can't cope with him (and don't want to imo).

CAHMs, Ed Psych and Behaviour Support involved and SS requested (by me) for a formal Assessment of Need.

My question though - is a Note in Lieu transferable? I've had enough of being contacted every day, had enough of their lack of any real support and think a move is probably best for him. Do I have to go through the whole process again?

Sounds like a move is the best (only)way forward.. Good luck..

I would imagine it is transferable just like a SEN is- your school will answer that.

Thanks for that. Sadly things have now moved on and he's been excluded because of his behavioural problems. So we're now having to look at EBD Unit for him as Ed Psych feels that this is really the only option for him at the moment.

When was the Note in Lieu issued? I'm afraid that there is no legal obligation for any LA to follow the recommendations on Note in Lieu. Only a full Statement would be considered to be a legal document describing the special educational needs of a child and the provision they need.

It sounds like your son has serious issues and should have been issued with a Statement rather than a Note in Lieu. If it was issued less than two months ago, you have the right to appeal against the decision not to provide a Statement and I'd recommend that you do this if you are within the time limits.

Please come and post again on the SN Children's board as there is a lot more traffic over there - lots of us have gone through statementing, exclusion, ADHD issues and can share experiences and advice. Smile
