Question about TM name in another country

Hello,

When considering a name for a business, if the name is used for a business in another country (registered not sure if TM - need to find out), is the name able to be used in a different country? The business does not appear to trade in the other country and appears to be small-scale, if this makes a difference. Would the alteration of the name be acceptable ie. using prefixes such as 'The' CompanyName or suffixes such as 'Co.' or 'Collective', or using the addition of a location as a prefix? The business name plus alterations of the name are available on the other countries business register.

Any information would be helpful at this early stage.

Just choose a different name, otherwise you risk customers getting confused when they Google your business or look you up on social media.

All these things are only as good as how much money you would spend to defend your trademark.

Try not to pick something that a global brand can come after, but otherwise than that leave the rest of the world to worry about itself.

Which country? Some aspects of trade mark law are governed by treaties and are pretty much the same worldwide save in some rogue states. Other aspects are not. So you are going to have very very different issues as between Ireland and Japan, for instance.

The answer to this bit:

is NO.

The answers to the rest of your questions need legal advice because they depend on the name, the other person, the industry, the mechanisms of enforcement, etc.
