Faulty product but no receipt or box ...what are my consumer rights?

As the title says really ...

Dd (2yrs) got a dolly as a gift of grandma for Christmas. The dolly is faulty but grandma hasn't got the receipt and obviously, we no longer have the box.

Does anyone know what my consumer rights are?
TIA

Is the doll the shops own brand? You might be able to get somewhere.
If generic or could have been brought from any shop, best bet is to try manufacturer.

I think your best bet is to hope for a gesture of goodwill.

Unless the doll is now dangerous - sharp bits of metal or whatever, don't think you need a receipt for that.

Any bank statement or other proof of purchase? Technically it is for grandma to sort out with the shop as she entered into the contract with them. In what way is it faulty , if it needs batteries make sure you have tried ultra strong ones as Baby Annabel etc won't work otherwise.

The dolly is from ELC (baby Maddy) and is the shops own brand.

No it's not dangerous, it just doesn't work!

I'm going to go and ask at the shop, but was hoping to be able to have some sort of right that I can quote.

Thanks for your reply

Nope, she bought it cash.

It's not the batteries - we've tried plenty [sigh]

She snores when she's awake and won't suck her bottle etc. Not the end of the world, but am a bit annoyed that it's not working properly when it should.

Thanks Lizs

Have you used ELC batteries. They have/had an annoying propensity (sp) to make sure that only their own brand batteries work in their toys. Remembers big argument after buying a pink CD player for DD from them.

You can ask for a refund or exchange in that case, more easily than if it were a branded one like Zapf.Info here They may not refund without any proof of purchase, preferring to replace like for like though or offer credit at whatever the price is now,ie reduced, unless you can show grandma paid more.

Itsjustafleshwound · 15/01/2010 16:59

I bought a keyboard from ELC recently and had no receipt or box - they replaced it no quibbles ...

Strangely, my friend has just had the same issue with a ELC doll - she took it back and they exchanged it without any fuss ..

It is always worth a try ....

If its faulty you should need proof of purchase - which is supposed to stop folk returning things to shops where they weren't bought. As this is clearly an ELC toy they should refund you. Could be more difficult if now in sale and as LIZS says you'll probably only get sale value.

DH took a dvd back to the shop as it wasn't working and he didn't have the receipt or box but showed them the bank statement showing the debit. It was exchanged no problem.

I think you are entitled to an exchange or refund without receipt if the item is faulty. Not fit for purpose.

FabIsGoingToBeFabIn2010 · 15/01/2010 17:04

The best bet isn't to try the manufacturer. Your contract (well, granny's) is with the shop, not the manufacturer. The shops need to remember that too.

Brilliant info - thanks all

I'd take it to ELC, they are usually very good with returns.
I have returned a few things without receipts and they have always been very helpful.

MrsDinky · 15/01/2010 17:10

I took a faulty Kidizoom camera back to ELC in September, having bought it last Christmas. I had the receipt but they didn't ask for it, changed it there and then, no fuss at all.

RockBird · 15/01/2010 17:11

If it helps at all I have just exchanged a pair of jeans that my SIL bought for DD in Mothercare. No receipt or proof of purchase and they weren't faulty, just the wrong size, so I should think it'd be fine.

differentID · 15/01/2010 17:11

Give the strore a ring and explain the situation

That way you can find out if they have the doll in stock and can exchange it straight away for you.
