Really need some advice RE this situation

Part C&P'sfrom another post, stillshaking that it'sChristmas and 2 boys haven't got a bed!

Ordered a bunk bed two weeks ago; ds3's bedwas damaged so had that and ds2's bedstaken by council day after delivery to allow space to set up.

Ladder missing side bars.

called to let them know, finaly had message to call them yesterday.

Just been told they will only send out if we pay: ds2 currently has to be lifted in to bed as its so high.

they say I have to order whole bed and then retunr parts we don't want for maybe a refund. I don't have the cost of the whole bed (over £200) two days before Christmas.I pointed out it wasn't uitable for the purpose for which it had been sold, she said I was right and should take to court.

Weeping here.

Start quoting the consumer goods act and trading standards. in fact get in touch with trading standards today if you can for advice.

did you get the bed from internet company or order from store?

internet order, they said that as wepaid cash they won't help- they agreed they breached consumer goods act but their suggestion was topay again then takethem to court to recoup money.

I'm a carer, that's4weeks income FGS.

I'm no expert but that sounds wrong. I think you need to threaten them with trading standards and follow it through. That sounds illegal although I could be wrong.

I'm not hopeful you'll get it resolved for xmas though

Only other thing I can suggest is the local paper - maybe the threat of bad publicity will alter their thinking.

just seen your other thread. They're supposed to be a new company judging by the adverts.

I would definitely be speaking to a manager and threatening adverse publicity. I'm not usually that bolshy but when you get the attitude of take us to court given all the expense that entails then i think they're fair game.

Call trading standards - they are really helpful, and sometimes a quiet call from them works wonders, and if not, they will advise you on how to proceed

Distance selling regulations say you can send back within 7 days for a full refund.

Your visa debit card should also be able to get the money back for you (reverse the payment) as they have breached their side of the contract. I would contact your bank.

They are Luittlewoods rebranded, yes.

I called CCD (thanks) and they said to sned a letter recorded, they have already contacted trading Standards as there is a breech of criminallaw as well (not sure what- credit act with their insistence on an account?used to know it well but been 15 years LOL). We have to wait 10 working days fromsending though.

We will ahve to sleep in the bunkbed tonight as ds2 keeps jumping ofgf the top bunk, and them in our bed. At lease we can do that (bottom is a double futon)
