HELP been sold unsafe bunk beds

I have bought these beds with a couple of the mattresses offered on the page.

Arrived ok but as we assembled them we found the mattress is too deep for beds - there is a line marked on ladder saying max height to comply with 'en747 - 1&2 2007'.

i have checked and this is a current safety standard. i am no expert but i suspect a standard and a regulation are two different things. my worry is the beds do comply with latest legislation - Bunk Beds (Entrapment Hazards) (Safety) Regulations 1987 - just not with more recent standards.

do they have to comply with standards? i have no intention of using mattresses - or prob beds the way i feel now - just wondering how much leverage i've got legally/morally/as consumer (and mumsnetter!)

anyone know anything which might help? i have emailed them asking them to replace mattresses with suitable ones (ie ones i agree to which are safety standard compliant) and if they can't do that removed beds and mattresses at own cost. i have said i will take legal action if necessary.

i haven't said how furious i am. i researched these bloody beds for ages and chose them almost exclusively on safety grounds so you can imagine my livid-ness. i'm shaking... grrrr

bump the more i read the more worried i get we don't have a legal leg to stand on.

can anyone offer any advice?! experience? tea n sympathy...?!

Have you tried contacting the company directly?
You may be able to swap the mattresses.
It's always worth a try.

yes, that's the first thing i'll do. they're not around on a sunday. my worry is they'll say 'everything is legal' ie conforms to regulations.

but that doesn't mean they conform to current standards (and the manufacturers clearly intended them to be hence clear mark on ladders saying 'mattress should only come to here').

but cos regulations are met, i'll be left holding two mattresses which cost £158 each and are no good to me (though only top one which really needs to be replaced, i'd rather both mattresses matched)

and we're in london and company in manchester so big deal to swap anything from their point of view. esp as i've no inention of paying for it. feell utterly mislead.

an update for anyone doing a search on bunk beds in future. the company have been great. the wrong mattresses were sent in error - they'll send replacements on Thursday. they have also knocked money off for damaged panels. their customer service has resolved the whole thing today and has been polite, prompt and professional. can't say fairer than that. a happy ending (i hope. as long as thursday goes to plan)
