Where do we stand with this legal people???

We bought a Viewsonic monitor a while ago,never really worked but recently died in warranty. DP rang to get a replacement and they sent us a reconditioned one which also didn't work. Theyve just replaced it with another reconditioned one today which also doesn't work.

As they have our original one(which some other poor sucker probably has now)I feel dp should just demand our money back,he's not sure he can. As far as I'm concerned 3 crap monitors is beyond a joke and we should just have a refund.

How long does this need to go on for? Surely all of us who were foolish enough to buy a Viewsonic(they're rubbish incidently)are just going to have our crap monitors consistently travelling around the country.

He says he's not sure the original warranty mentioned re-conditioned it does now on-line but we obviously don't have the original. Have never come across a company replacing damaged goods with more damaged goods

not really sure where you stand, but if you paid by credit card and it cost over £100, you should be able to get a refund from the credit card company. don't know what the process is, but you would need to give them a clear summary of what happened when, and ideally all the attempts you have made to get things sorted out.

if you didn't pay by credit card, I think you still have a case as what they have sold you is clearly not fit for purpose, but have no idea whether they are within their rights to give you a reconditioned monitor instead of a new one (always suspicious of reconditioned things since we bought a reconditioned Bose wave radio and it's never worked properly....)

It's definitely worth asking for your money back - if they are difficult I think it is your statutory right to receive it as they have clearly sold you faulty goods, but some places have a policy of credit notes etc. Also, don't be fobbed off by them telling you it's outside any time limits (eg 28 days or whatever) as you have clearly been having problems for some time.

Many thanks for that-guess what another one arrived today and yup you guessed it doesn't work either!!!!!!!!!!!!!

DP has actually agreed to them sending yet another one on Monday I could strangle him!!!!!!

If that one works I don't want it as no idea how old it'll be or it's history or how long it'll last. Don't understand how companies can get away with send crap out to replace the original crap that got sold

Going to show dp your post might help to make him demand our money back.

The problem is he may well be deemed to have now accepted a replacement rather than be entitled to a refund. I assume you bought direct ?

No via Amazon.

I'm nearly 100% sure the one on Monday won't work either so am presuming we'll still be able to demand a refund.

If by some sheer miracle it works I'm guessing we'll have to keep it.

Unless you bought direct(ie they were named as the seller) it is Amazon, as retailer, who should be dealing with it then. See here
