Refused a refund for faulty goods

I ordered my husband some heated gloves for Xmas. When he went to plug them in they wouldn't heat, and the cable supplied is frayed and broken

Immediated emailed asking for a refund. Company offered a replacement

Emailed back saying no, we want a refund. They responded saying because we had opened the package they could only do a replacement. Which seems ridiculous - the product is blatantly faulty.

I have no faith in the company or their products so definitely want a refund - what are my rights here?

Was it more than thirty days since you received the item?

If it was less than 30 days, write back quoting the Consumer Rights Act - refund for items less than 30 days since you took ownership of they are faulty. If it is more than 30 days then they are entitled to offer a replacement or repair in the first instance.

No, I ordered mid December and they arrived early Jan
