Hey all, sorry to be dramatic but have been very burnt by this site and don't want the same to happen to others.

Story: My husband ordered some stuff for our son for holiday when he was going to be 9 months old (May 08). The clothes arrived, I looked at them and immediately realised they would barely fit him at 6 months, let alone 9 months. I emailed them, about 10 days after delivery, enquiring about the sizeing of their clothes and heard nothing back.
After another 10-14 days I mailed them again to say that I would be returning the clothes as the sizes seemed incorrect and I hadn't heard from them regarding my initial enquiry.
Well, as if by magic I heard from them immediately! Kindly informing me that their returns policy was within 7 days and my initial email was outside that. Now, any internet company with a policy that operates on a 7 day only returns basis is obviously dubious so I tried to continue negotiating with them. I pointed out that they had still not replied to my initial sizeing query and was mailed back, stating that they were extremely busy as it was their busy time of year and I should bear that it mind.
I mailed back pointing out that if I should be understanding of them being busy, then surely they also should be understanding of customers wishing to exchange.
Their response? Couldn't care less....

How did you pay for the clothes? Credit card? Have them deal with it for you. Also, check what your statuatory rights are.

Why did you wait 10 days after delivery to contact them?

Miggsie · 28/03/2008 12:10

legally you have 14 days to return goods bought by mail order/interent.
contact the credit card company and get them to deal with it,they are equally liable.
The company cannot have a returns policy that is less than the legal one.

wannaBe · 28/03/2008 12:12

so the terms of their site say to return products within 7 days of receipt and yet you waited 10 days?

Sorry but you are the one in the wrong and not the company..

vonsudenfed · 28/03/2008 12:12

Sadly, under the Distance Selling regulations, you do only have seven days to return the goods.

They are clearly being arses in sticking to the letter of the law, but unfortunately they're within their rights.

I've never had any problems with them, but I do get the impression it's a small, family run company. But if you waited almost 3 weeks until asking about the returns policy, that's probably why you've had no joy tbh. Sorry.

There are lots of companies internet or otherwise that operate 7 day after delivery return policies so they might be in their rights to reject your request. Not sure what the legalities are here - have you thought about contacting trading standards or citizens advice to see hat your rights are?

My problem with them was that the sizes were obviously incorrect and all I wanted was some information from them and I was completely ignored. In all my dealings with them they still never, ever replied to my query. It was the fact that they replied immediately when I said I wanted to send the items back. I was so disappointed with their attitude which is why I then went to return the products. I felt I had a completely genuine enquiry which I was sure must affect many people who purchase from them and their whole "well its too late for you to do anything about it anyway so tough" reponse seemed very nasty.

And I was also completely unaware of the 7 day return policy as I didn't purchase the goods.
