2012 Vauxhall Astra question about warranty.

Hello.

I purchased a 2012 Vauxhall Astra in January 2014, I have done approx 3000 miles since I bought the car now it seems to have failed on me. The Vauxhall garage I got it from have said its not a manufacturing fault therefore wont pay for it, however it cant be misuse I only go to work and back.

I do believe its still in its 3 year warranty, where do I stand with this as I haven't messed with the car or touched it? They "said" they did a check of the car and service before I bought it but there is no record of this in the service history book.

What's the actual fault? Has it ever been serviced? How many miles had it done?

So far they are yet to find a fault with the car, however the white smoke and chugging of the engine tells me otherwise.

Vauxhall said when I enquired about it that they had done a service on the vehicle, which I have found out is not true. The car has now done 28,000 miles.

Has it ever been serviced at all? Is it petrol or diesel. Can you ask the supplying dealer for details of the service they told you it had? If you can get that info from them and the rest of the service history is to schedule then try a different dealer as suggested. My fear is that the paper/computer trail won't work out which as far as Vauxhall are concerned will void the warranty. Your argument is then with the supplying garage to prove the service and therefore reinstate the manufacturer's warranty or go after them from a SOGA angle. I guess it could come down to your word against theirs though regarding this service which could be a pain in the arse.

I believe that a fault that occurs within 6 months of purchase is deemed to have been present at time of sale so a supplying dealer should be duty bound to rectify.

However, it's this sort of crap which means I won't touch a Vauxhall - too many stories of them not giving a shit and doing whatever they can to avoid warranty claims.

Yes WM but I'm willing to bet that the supplying dealer will have the perfect get out clause for SOGA by saying that the car hasn't been serviced/maintained. I think it's going to come down to the OP's word against theirs.
