Can you appeal against an exclusion from school based on the grounds that it was unfair?

has anyone had any experience of this or any help would be appreciated...I have an interview with the head of year on Monday morning and I would like to go in being well equipped iykwim..thx for reading

It depends whether we are dealing with a permanent exclusion or a fixed term exclusion. If it is a fixed term exclusion and, including this exclusion, your child will have been excluded for 5 days or less in the current term you have no right of appeal. You can still write to the governors and they may agree to meet with you. However, they don't have the power to overrule the exclusion. The most they can do is place a note on your child's file saying that they disagreed with the school's decision to exclude.

For longer exclusions or if your child will miss a public exam you can appeal to the Governors. In these circumstances the Governors can overturn the school's decision.

For a permanent exclusion you can make representations to the Governors. If they don't agree with you, you can appeal to an independent panel.

If you have the right to appeal you can argue that your child didn't do whatever they are accused of doing. You can also argue that the school was wrong to exclude your child for whatever they are accused of doing. So yes, if you are entitled to appeal, you can argue that the exclusion was unfair.

Need to know more details but the fact you are seeing the head of year suggests that it was a short fixed term exclusion and this is a re-integration meeting. Anything else and i would be expecting to see the head teacher.

Have you not had any letters regarding the exclusion. They should have given some information on your ability to appeal the exclusion?
