How can we cancel an EHCP for Year 11 and college?

DD who is going into year 11 has an EHCP since year 6 due to a mild developmental language disorder. Having this plan has made her very unhappy and she requested this plan to be cancelled. School said they will request this.

We just received the outcome from the council and they said no change is needed.

How do we cancel this plan? She is planning on going to college after this? Will this follow her for life?

Most of the things written there are not valid any longer.

It seems there was a misunderstanding or perhaps the school asked for a different thing as they don’t want you to loose the funding and didn’t send us a report.

I replied to the council and they got back to me straight away and asked if we wanted the plan to be ceased or amended? And that if we wanted this to be ceased they will action straight away.

Be careful before you cease (end it). Ask for a reassessment and say that her current plan doesn’t reflect her current needs. If after that it’s agreed she doesn’t meet the threshold for an ehcp then you’re no worse off.

You should make a complaint about the council not following process after AR Ipsea has an excellent flow chart plus all the laws about it.

id check your child’s section F (and B too) does she have Salt / OT / 1 to 1 / room adjustments / laptop / scribe etc all of those things should be happening.

Also, EHCP can last up to 25 if she got unwell. It does give “some” protection to keep her in education a bit longer.

It sounds like your one is years old and needs updating but what is school providing which the NT isn’t getting in the same class as your child? There must be something on the EHCP in section F?

Personally, I would be pursuing amendments rather than accepting the LA will cease to maintain.

The current EHCP doesn’t sound like it is meeting DD’s needs, but that isn’t an inherent problem with EHCPs in general, it is a problem with the content of DD’s EHCP and that content can be improved which will be especially important as DD moves towards phase transfer.

The LA is ultimately responsible for the overall AR process, but the school should have circulated the report within 2 weeks of the AR meeting.
