Help with school issue

Just don’t know what to do anymore, can someone please give me some advice on what to do for the best?
I have one child who is home educated but I can’t do it anymore, it’s been almost 3 years it was never meant to be this long. She is autistic and has learning difficulties, she can’t attend a mainstream school but the LA won’t place her in a special school (hence being home educated) we had an annual review recently where I had hoped to get her a place in a special school however the final draft came back still naming mainstream (despite the case officer telling me she recommends a special school 🙄) ive appealed to tribunal but court date is a whole year away.
I can’t do this any longer I explained to them I can no longer home ed her, ive considered sending her to the mainstream named on her ehcp for an hour a day so I can prove she can’t cope in mainstream, however my son attends this school and is in the Sen department there (he is also autistic) and he said if I send her there he won’t go anymore and told me that I can’t send her there as he doesn’t want anyone to know they are related as he is worried he will get bullied because of her (now I must explain he is not being mean her behaviour is very challenging and she behaviours in an inappropriate manner and doesn’t understand social norms, he is also worried he will basically become a carer for her) I’ve only just got him back into school after 4 months of being unable to attend due to bullying and he said he can’t have her at the school not even for an hour.
So I am stuck because it’s the school right next to us and I’m not comfortable sending her to any other mainstream schools further away as I don’t drive and won’t be able to get there if they call me to pick her up which is likely to happen regularly as she can be aggressive has behaviour issues and she’s also been known to escape school so she will be a risk if she’s at a school far away or an area she doesn’t know. This school is 5 minutes walk away so at least if she escapes or they need me to pick her up I can be there in 5 minutes but my son is really upset about me sending her there and says he will get bullied and he wont want to go if she is going to be there.
What do I do? I feel like I have to do this and put her first as bad as that sounds but she can’t miss another year of education but then someone told me I wouldn’t be putting either kid first if I put her there and shouldn’t be sending her if I feel she wouldn’t cope so what else can I do? I’m desperate.

There is a SEND board too. My gut instinict is send her to school but I maybe wrong.

Does DS travel to school himself? Can he go earlier so he isn’t see with her?

If you’re not already in contact with them then please contact your local SENDIASS team.

They unfortunately will be in the same class as he is in the Sen room this is for all children with Sen and covers all year groups that can’t manage in regular class rooms

I presume you mean the finalised amended EHCP still names MS rather than the draft? Drafts shouldn’t name a placement or a type of placement and you need the final to appeal.

Have you requested an expedited hearing because DD is out of school?

Have you thought about evidence? Do you need independent assessments? Do you have it in writing from the caseworker?

If you no longer wish to EHE, you can inform the LA you are not EHEing and that they need to make suitable alternative arrangements because DD is unable to attend school. If the LA delay, refuses or ignores, you can challenge this decision.

If you want to send DD to school, can you reason with DS, saying he doesn’t have to care for DD and can completely ignore her? He can do this even if he is in the same classroom.

Be careful with SENDIASS. Some are good but too many repeat the LA’s unlawful policies.

Make sure you have some professional reports (EP / OT etc) that’s the only way with evidence. Have you found / visited a special school that will actually be suitable in the local area? Ok saying yes to a special school but is there one that would suit your child’s needs within travelling distance? Have you visited some

They will be in the same class as mentioned he is in the Sen department which is where she will be, I’ve told him to just ignore her but he said they have the same surname and look alike so people will know.

Yes we have and they also visited us they said they could meet needs but the LA still said no
