Does EHCP assessment process cease if I deregister

Hi,

I am thinking about deregistering DS from his mainstream secondary school to avoid attendance processes starting while we await completion of the EHCP assessment.

I wondered if anybody knows whether the EHCP assessment process would be cancelled if I deregistered from the mainstream school to electively home educate?

Ideally we would like the EHCP process to run to completion so we would have help to get DS into a suitable school at A level.

@Zyq Is that really not right then?

It's so stressful and I just want peace so my son can recover and get on with his learning at home.

The whole system seems to be riddled with rules that all contradict one another, and nothing makes sense at all.

The attendance office didn't email back, so I'm still none the wiser about whether we are likely to be subject to attendance processes.

My poor son is so stressed. I'm starting to think that I should just not tell him anything at all about what is going on, and maybe then could calm down.

The EHCP would not be taken away once you have it and you deregister. It would become the responsibility of the local authority, rather than the school’s. However as many people have said, deregistering in the middle of the process would be a set back.
It Sounds like you have not had any letters re attendance and you have clear and justified reasons for your ds’s absence. Lots of people have said you don’t need to worry about procedures starting against you, but you seem to find that hard to accept.

your ds is already very anxious and it sounds like you are too. why would you add to his anxiety about this? What do you think might happen? Of course he doesn’t need to know. Tell him it will all be sorted and he won’t have to go back to school until he is ready to if and when that time comes. You need to keep that in mind too. You are his best advocate, he is looking to you to know how to manage situations.

The law isn’t contradictory. What is confusing is when parents believe the unlawful policies and myths LAs and some schools perpetuate. Stop believing everything the LA and school tell you!

You don’t need to tell DS everything that is happening. That only serves to cause him more stress. I am surprised you have told him everything until now.

It's okay, we're good.

The duty officer just said that I must email the attendance office, so I did that. I have to follow her word really as she is the authority figure here. Much as I love and appreciate the MNers, I need to respect the people who are calling the shots here. For some reason, quoting laws is getting me absolutely nowhere.

You have to enforce the law, not just quote it. The LA can’t ignore enforcement action for long.

No-one has suggested not being peaceful.

The sad reality is DC whose parents advocate for them and enforce their rights get better support. It shouldn’t be that way, but it isn’t going to change anytime soon.
