Admission into secondary school appeal

Hi Everyone , pls I am in need of advice , we recently moved to new area in Essex in December 2023 after secondary school application had closed.The application was submitted on time to my previous borough.
I contacted the Local authorities to notify them of the move before the national offer day, as the school I chose as first preference for my son was about 0.35km to the our new house .Surprising He was not not shortlisted for the school. The reason school admission gave was that the application was not high enough for my school to be admitted to the preferred school which is one of the good school in the area.He was given a school that is list as requires improvement by Ofsted. I choose the school because it is closer to the house as it is a new environment to all of us, it will be safer for him to travel alone to and from school ,also he is the sort of child that like to learn different kind of language and be involved in variety school activities including sports and acting which he preferred school offered . I do not know where I stand if I want to appeal or school I get solicitor involve or face the appeal panel myself again ?
He was unable to get into any of the closet primary school in the new area hence as we both still works in London we have to bring him to school in London everyday from Basildon which is where we moved to .We lost the appeal for him to get into the closet primary school to the house in February this year.
Any advice will be much appreciated .

Presumably this was an application based on your old address, unless you fell within the window to update it and still be treated as on time from there. Are you on waiting lists, if so where? Logistics won't win an appeal, nor will criticising the offered school. Language options etc may be an argument if you can demonstrate it would specifically benefit your ds, not just a nice to have. You do not need a solicitor to appeal and the offer letter should instruct you how to.

I wouldn't get a solicitor. Most don't understand admission appeals and do more damage than good.

As you applied to Essex after the closing date for applications, it is not surprising that you didn't get a place at your preferred school. You were a late applicant, so your application would only have been looked at after all the on time applicants were dealt with. The fact you applied on time to your previous borough is irrelevant.

To win your appeal, you need to show that the disadvantage to your son from not being admitted outweighs any problems the school will face from having to cope with an additional pupil. You talk about sports, acting and language. If these things are not available at the allocated school and you can show that they are particularly relevant to your son, they are the kind of things that can help your appeal.

With a bit of luck you may not need to appeal. As your application was late you obviously wouldn't have got a place in an oversubscribed school in the first round. However there is almost always some movement from waiting lists between March and September and you are likely to be high on the waiting list as your new address is so close. Make sure you are on the waiting list with your new address. Someone with an offer for the school you want will have an offer from a private school too, or will have parents who need to move to Scotland for work, and a place will become available.
