Hi there,

I have trawled through so many of these threads but am still really struggling. I'll explain my situation and hope that someone can help.

My daughter got given her second choice school, our local school, back in September. It was not our first preference.

She has had an absolutely awful time since attending. She has struggled with anxiety for years and I strongly suspect she has SEN. However the majority of her anxiety has been handled at home by us bar a few trips to the GP some years ago. I mentioned the potential SEN to her old school and was told there was no chance, I strongly believe this is because she presents very neurotypically outside the house and for the most part enjoyed the nurturing environment of her primary school.

The school she was sent to is known for being a school with terrible behavior, there is a high staff turnover, its always undersubscribed and has a pretty terrible reputation.

Quickly after attending her anxiety went through the roof and she became utterly miserable. She struggles with sensory issues and panic attacks and these both also went through the roof, mainly due to the behavior of others in class, the loud shouting and screaming, the uniform, the environment. Despite several meetings with the school nothing was really done other than a promise of a triage for a counsellor and a promise of school class changes (the behavior in her class was exceptionally bad, her head of year told me) that never materialized. After a few months of this the anxiety and school refusal (she's never school refused before) became so bad that I literally cannot get her into school anymore, I'm talking massive meltdowns, hysterical tears in the morning, barricading herself in her room etc. It was destroying her. So we're keeping her on roll atm and I'm waiting to hear back about how we will move forward whilst attempting to homeschool around two jobs.

There is a school a little further away (we are just out of catchment) that she is desperate to attend. When we went to look around she couldn't believe students were actually learning, loved the environment, the comfier uniform. I strongly believe by attending a school with a nurturing environment and strong pastoral care that she will once again like school and thrive.

We have applied and been denied which we knew would happen and are 4th on the waiting list. I am planning on appealing but I'm worried my argument is weak.

Some facts-
They are already 6 over PAN in year 7.
I have a letter from GP confirming anxiety based school refusal supporting moving school.
I have a letter from her old headteacher specifically naming the other school and that my daughter would be far better there.
I have registered with wellbeing service.
We are on the pathway to a diagnosis now.

I'm wondering how to best base my appeal. Would it be better to keep her on or bring her off roll? Would a private diagnosis help?

If they’re already over PAN and you don’t have an EHCP, it’s not going to be easy.

Is there something the preferred school offers that is particularly good for your daughter, such as music tuition, or sport, or drama, that the school she’s currently at doesn’t offer and that she’s talented in.

You can apply for an EHCP yourself.

Sorry, you can apply for EHCNA - the needs assessment. IPSEA have sample letters I believe.

Looking at other things the school offers is a good idea. Do you have evidence that school is best from a professional other than the old school?

I second requesting an EHCNA. In the meantime, don’t deregister. If DD can’t attend school the LA should be ensuring alternative education is in place. Are they?

I have been racking my brains but I can’t think of anything. She’s a very keen footballer but does that a lot out of school and old school did that anyway.

the school were appealing for offers more than one language which she’s interested in but I can’t prove it.

the only thing I have is that the school has a strong pastoral and emphasis on mental health and I know she’d be so much happier and able to attend that school setting and get the education she needs. But j know I can’t really appeal on that alone?

They’re honestly just very keen to get her off roll. I have a meeting with them on Thursday though after much badgering and turning up asking for someone to please speak with me!

You can appeal on the mental health/pastoral/SEN needs alone, it would just be stronger if you cover other factors too.

Don’t allow the old school to off-roll. It is often easier to get support when DC remain in the system even if they can’t attend school. It is easier for professionals to sweep DD’s needs under the carpet if you deregister and home educate.

An EHCP can provide DD with more support, including therapies, and it will also name an appropriate school. However, it won’t be a quick fix so you should continue with the school appeal.

What is PAN for this school? That will determine how significant the fact they are already over PAN is.

This appeal will be decided on the balance of prejudice. You need to show that the disadvantage (prejudice) to your daughter from not being admitted outweighs any issues the school will face from having to cope with an additional pupil. You already have some good arguments supported by evidence in the form of a letter from her old head and a letter from her GP. If you have any evidence that her current school is aware of the issues and has failed to do anything effective to address them, you should include that.

You should look to see if there is anything else this school offers that is missing from the current school. You've already got the nurturing environment and pastoral care, but is there anything else? Are there, for example, extra-curricular activities that are relevant to your daughter? For example, if she enjoys sport and the appeal school offers more opportunities for her to take part, that is something you should bring up, particularly if she is good at sport.

You should major on the things you've talked about in your first post, but adding a few other points may help to strengthen your case.

so the PAN for the school is 232 and they are 6 over according to the admissions lady.

the school itself though has 1152 students in so is under as a whole?

she does love sport but I’m not sure how to go about finding out if they have more chances for her to participate. I’m very friendly with the football coach from her old school so I know he’d help support in anyway he can if that’s of use?

With a PAN of 232, they have at least 8 forms in Y7, so being 6 over suggests they could accept at least another 2 without too many problems. If the school is under capacity, that helps.

The appeal school must answer any reasonable question you ask to help you prepare for your appeal. If you want to know what they offer in terms of sport, ask them.
