False Acquisition of sexual harassment - Sixth form

My daughter was falsely accused by another girl same class in the sixth form. The acquisition is that she had touched her inappropriate place. The school had informed the police / social service and waiting for their investigation. But due to this my daughter's life in school has become very difficult. The school has also imposed restrictions on my daughter while allowing another girl to continue. She has not done this because she had not interacted with her on that day.

What shall I do? Do I need to contact a solicitor to help her as it is a false acqusiion?
Any pointers will be much appreciated.

Has anyone questioned your daughter yet? School or police? Do you know any details, as in when ,where etc?
Can your DD prove she wasn't anywhere near the girl that day?
Does your DD have any inkling why the other girl might lie? What's the history between them?
Is your DD gay?

Has your daughter and any friends/alibis been asked to write statements? Is there CCTV?

Why does your daughter think the other girl has done this if it isn't true?

I am sure the autocorrect misspelt accusation.

I have seen this happen before. In the case I know about the girl making the accusation had a history of being removed from independent schools. This girl lashed out and had a troubled home life. In a similar situation, the school informed the police and made the accused girl leave. The girl who made the accusation subsequently ran away from school with a boy and wasn’t found for 2 days. It was a boarding school. She was then permanently excluded.

So you need to get the full picture of the accuser. Don’t sit back. What is she really like? The school believed the girl who made the accusations but it was malicious. Everyone else knew that. Be very careful though. Accusers have all the law behind them. My own DD wasn’t involved but it was in her House. Everyone bar the school and police knew it was malicious. Stay steadfast and support your DD.

I am trying to get more details about another girl. She is 2 years older than my DD but in the same class. I just came to know that she had accused someone in past but no proof yet.
Do I need to get a solicitor to help my DD?

I honestly don’t know if the parents of the girl accused did or not. I do know the school had to apologise and offered her place back. (I suspect the financial/legal clout of the parents might have brought this about). She didn’t come back. Parents were mega wealthy. My strong guess is they would have had a solicitor. Police were informed and spoke to pupils but didn’t take it forward. Pupils were told a prison sentence was the ultimate sanction though.

The girl that accused the other one was known by the pupils and some staff to be, shall we say, trouble. Once she accused the girl, she was believed. The school got rid of the innocent girl on the word of one troubled girl. No one, as far as I know, ever corroborated what she said.and there was no “evidence”. Just pupils saying they knew nothing. Which they didn’t. But the school acted.

I would, however, get a solicitor I think. Has the school suspended your DD? What have you been told about any investigation? I would also suggest your DD thinks about who might speak up for her and who was around. Of course if it’s all a fantasy, no one.

These kind of accusations are always difficult. Without knowing what restrictions have been put in place it is impossible to be sure, but the school may well be doing the right thing. The restrictions should be to protect your daughter from the possibility of further accusations as much as to protect her accuser.

Your daughter shouldn't need a solicitor at this stage. However, if the police decide to interview her, you should definitely get a solicitor involved.

Presumably the allegation is credible in that, although you say your daughter did not interact with her accuser that day, from the school's perspective it is possible that she did. It is worth, if possible, putting together a timeline of where your daughter was throughout the day in question, including time spent moving between classes, and identifying who might be able to confirm where she was and that there was no interaction.

The accusation must be investigated properly, even if the accuser has made false accusations in the past.
